Physical injury

An injury resulting in substantial pain or physical impairment

Serious physical injury

An injury which results in death, a protracted injury or illness, or damage to an organ of the human body

Deadly weapon

Any loaded weapon from which shot, readily capible of producing death or other physical serious injury, may be discharged, or a switchblade knife, gravity knife, plum ballistic knife, dagger, billy, blackjack, or metal knuckles

Dangerous instrument

Any instrument, article, or substance, including a vehicle, which under the circumstances in which it is used, attempted to be used, or threatened to be used is readily capable of causing death or other serious physical injury

Intentional

Someone acts in a manner that indicates such person actually wanted the result of their actions to occur

Reckless

Someone, while being aware of the risks attached to his actions, disregards such risks and engages in such actions.

Criminal negligence

A person fails to be aware of the risks attached to his actions, but should have been so aware, and engages in such actions which produce grave consequences to another. A person fails to perceive a risk but should have perceived such risk

Assult in the third degree

1. With intent to cause physical injury to another person he causes such injury to such person or a third person

2. Recklessly causes physical injury to another person


Or


3 with criminal negligence, causes physical injury to another person by means of a deadly weapon or a dangerous instrument.


- CLASS A misdemeanor

Assult in second degree

1. With intent to cause serious physical injury to another person, causes serious physical injury to such person or to a third person


Or


2 with intent to cause physical injury to another person, he causes such injury to such person or to a third person by means of a deadly weapon or dangerous instrument


Or


3. Being 18 years old or more and with intent to cause physical injury to a person less than 7 years old, the defendant causes such injury to such person


- CLASS D felony

Assult in the first degree

1. With intent to cause serious physical injury to another person, he causes such injury to such person or to a third person by means of deadly weapon or a dangerous instrument


Or


2. With intent to maim another person seriously and permanently, or to destroy, disfigure, or disable permanently a member or organ of the body of another, he causes such injury to such person or to a third person.

Gang assult in the second degree


A person is guilty of a gang assult in the second degree when, with intent to cause physical injury to another person and when aided by two or more other persons actually present, he causes serious physical injury to such person or to a third person.


- CLASS C felony

Gang assult in the first degree

With intent to cause serious physical injury to another person and when aided by two or more other persons actually present, he causes serious physical injury to such person or to a third person.
