ln a single judge trial of an information in a LCC, the court:

1. determines all questions of law


2. is the exclusive trier of all issues of fact


3. must render a verdict.

The order of trial is as follows:

1. Court May allow parties to deliver opening statements.


If the court grants permission to one party, it must grant it to the other also.


If both parties deliver opening addresses, people must deliver an opening address first.


2. The order of trial is the same as in the trial of an indictment.


3. Court MAY allow parties to deliver closing statements.


If court grants permission to one party, it must grant it to the other also.


If both parties deliver summations, the defendant’s summation must be delivered first.

The court must render a verdict upon each count not previously dismissed. A verdict which does not so dispose of each count constitutes a verdict of

NOT guilty with respect to each indisposed of count.


Court may find defendant guilty of a count charging a misdemeanor, or guilty of any lesser included offenses which is established by legally sufficient trial evidence.

EXCEPT for “A” MISDEMEANORS, court May with agreement of parties assign a judicial hearing officer to conduct the trial.
