Railway Labor Act

Applies to airlines/railways. States the right of employer/employee to choose a representative. Imposes a duty to mediate/arbitrate. If that fails, a 30 day injunction can be ordered by the president if it's hurting the nation.

Norris-LaGuardia Act

Adopted in the last days of the Hoover Admin. Divested the court of injunctive power in labor disputes unless life or property was at risk, and severely limited agency of unions for the unlawful actions of individual members during strikes.

Wagner Act

Also known as the National Labor Relations Act (NLRA). 1. Gives employees the right to form unions and bargain collectively. 2 Forces employers to treat with unions 3. Gives Fed power to prohibit actions of employers that interfere with these rights. Jurisdiction: All but managers, domestic workers and indep contractors.

How is a Union Installed?

1. Voted into office by employees


2. Campaign where management and union attempt to convince employees to vote their way


3. Employers right to free speech is curtailed


Collective Bargaining Agreement

If Union is voted in, the employer and it sit down and negotiate this. Required to bargain in good faith about wages, hours, working conditions. If they can't agree, employees may go on strike, or work w/o contract for a while.

Taft Hartley Act

Encouraged Dispute Resolution by having trained mediators work w/ affected parties. Brought back presidential injection - 80 day cooling off period.



Employees as well as employers must bargain in good faith.



Outlawed closed shop -- employees only choosing from a pool of applicants put forward by the union. However, being compelled to join a union is ok, except in right to work states



Created a new category of Unfair Labor Practices by unions, no secondary boycotts or coercing employees to join unions.

Landum Griffen Act

Response to gang ties and corruption in unions



Guarantees right to speech by every member, right to vote in union elections, right to nom members for office.

Employees cannot be fired if dismissal contravenes with pub policy



Violates an implied contract term of good faith and fair dealing.
