A patient placed on a 5150 does not have any right to challenge the hold.




The short hold allows the evaluation and protects patient and society (parens patriae). Once a 5250 (14 day hold) is initiated, the patient can file a writ of habeas corpus. The patient must file the writ, family cannot do it.

Emotional Abuse Reporting (elderly)

Emotional abuse reporting is optional. Neglect, abandonment, isolation or financial abuse is mandated.

Resolving multiple relationships

The APA Code states that when a harmful multiple relationship is recognized to exist, a psychologist should attempt to resolve with "due regard for the best interests of the affected person and maximal compliance with the EC". Other actions MAY be appropriate such as clarification of roles, pre termination counseling and referral to another therapist but it is not necessarily the best solution.

Subpoena

A subpoena is a legal document and may never simply be ignored, including when there is a malpractice lawsuit. The psychotherapist must show up at the appointed time with the required documents. Although the therapist may assert privilege, this does not mean that the subpoena is ignored.
