Seperation of Powers

- Executive power (administer government and manage business of government, vested in crown)


- Legislative power (make laws vested in the parliament)


- Judicial power (enforce laws and settle legal disputes, invested in the courts)

Reasons for Separation of powers

- Provide stability of government and the freedom of the people


- Provides independence between the bodies that make law and the bodies that enforce law


- Provide check on the power of parliament to ensure that it does not go outside its area of power.

Parliament, Government and Cabinet

Parliament: Law making body that consists of all members of both houses + crown


Government: Form by political party (or coalition) with the majority of seats in the lower house of parliament


Cabinet- Policy making body made up of Prime Minister, crown and senior government ministers.

What is the Executive Council?

Member consist of the Prime Minister, senior members and the crown. Roles include: advice about government, establish departments, appoint ministers to administer them and to approve delegated legislation

Role of Crown

- Give or withhold royal assent


- Dissolve the parliament and issue writs for new election


- Officially common the PM and appoint other minister after elections


- Officially open and close Parliamentary sessions


- Act of advice from minister through the EC to issues regulations and proclamations


- Overrule or disallow a commonwealth law win a year of RA
