What law governs orders in council |
The Emergency Powers Act 1920 which allows the Queen and Privy council to make law when Parliament is not sitting. This is used during an emergency such as during the foot and mouth crisis in 2001. |

When are orders in council used? |
When regulating certain bodies. When responsibilities are being transferred between government departments. To dissolve Parliament before a general election. Occasionally used to make specific law changes. |

The 2004 amendment of the Misuse of Drugs Act 1974 which changed the classification of cannabis to a class C drug. |

Confer powers on ministers to make more detailed orders, rules or regulations. |

When are statutory instruments used? |
To vary the dates in which different provisions of an Act will come into force. To change the levels of fines or penalties for an offence. Often to provide necessary detail within Acts of Parliament which otherwise just consist of a basic framework. |

Regulation of the Investigatory Powers Act 2000 which allows certain bodies to carry out undercover surveillance, but does not detail who these bodies are or who within them can authorise such surveillance. |
