Survival Statute |
(1) Provides that the cause of action for personal injury to the plaintiff (before death) survives the death of the plaintiff or the defendant or both. (2) If it is the D who has died, the claim may be brought against the D's estate. (3) If it is a P who has died, usually the claim can be brought by the executor or administrator of the estate on behalf of the estate. |
