Wrongful Death

An independent cause of action for damages caused by the death of the decedent brought on behalf of certain beneficiaries of the decedent as defined by the statute.

Survival Statute

(1) Provides that the cause of action for personal injury to the plaintiff (before death) survives the death of the plaintiff or the defendant or both.


(2) If it is the D who has died, the claim may be brought against the D's estate.


(3) If it is a P who has died, usually the claim can be brought by the executor or administrator of the estate on behalf of the estate.
