What was theatre like in 19th century?
Actor-companies with actor managers.
What happened in 1860's to change theatre?
Railroads. They were now able to travel with their shows.
What happened in the early 20th century to change theatre?
Movies.
What happened in the 1930's to change theatre?
WPA. FTP. The national theatre conference was started.
How were the original not for profit theatres different than prior theatre companies?
There were in it for the art, not the audiences.
What foundation helped start new not for profits?
Ford foundation started in 1957. Headed by W McNiel Lowry. Earmarked $60mil to art org. TCG was also established.
Why did equity need a new contract in the 60's? What was this contract?
LORT. Regional theatre contract.

NEA, in 1965.

Getting back your original investment.

What is copywright?
Protects intellectual property. Allows author to retain ownership or his creation. Protects the expression of an idea, not the idea. Does not protect title of idea.
When does copyright take effect?
At the moment of creation.
What does the Lanham Act say?
Even though your title is not copyrighted, if it will be so unfair and will confuse audiences, its not allowed.
When was the original copyright act enacted?
1909, had to register. Term 28 years, renewable 28 years.
Problems with original copyright act?
Forget to renew, outlive copyright.
When was the new copyright law enacted, what is the new law?
1978, life of the author plus 50 years.
What was changed about copyright due to Disney?
Works prior to 1978 have 95 years.
What is a work for hire? Who gets copyright?
Hired creativity. Copyright belongs to employer.
What is a property?

What is scope and territory in a contract?
Scope: how you see the play done
Territory: where you see it done and for how long
What is public domain and its implications on theatre?
Works which are past their copyright date. They are free to use and adapt.
Option vs License
Option is exclusive rights for a certain amount of time. License is rights for a specific time and place.
What is warranty and indemnity?
Warranty: the author gaurantees property is his work.
Indemnity: Author will pay for all costs if above is not true.
What are royalties?
A percentage of box office gross weekly reciepts sales associated with the property paid to specified person.
What is a waiver?
If everyone involved waives 50% of their royalties, then % for royalties will rise. Makes investors happy, they get paid back quicker.
What is a defferal?
Putting off paying royalties. This is bad don't do this.
What are enhancement deals?
You get money, give up artistic control. Theatre may get future participation.
What are subsidiary rights?
Rights to a percentage of everything else to do with the show. Retail, licensing, etc.
What is a co-pro? What are pros and cons?
Co pro is two theatres working together to put on one production. Will usually present in both theatres. Saves on rehearsal, costumes, props, set. Must pay rate of bigger theatre. Must pay for set moves, lighting twice.
What are the roles of the board of directors?
To maintain a healthy organization.
