What was the understanding of the commerce power under the Taney Court?
That States have a legitimate police power for the health and safety of citizens.
If something requires national uniformity or regulation, then it requires the exclusive legation by Congress. Until Congress finds it necessary to exert is power, it should be left ot he states.
What did Prigg and Dred Scott do?
Said that all African Americans were non-citizens regardless of slave status.
Prigg said that the FSA can't interfere with state police power but that states can't act in a way to stop slaveholders.
Prigg also stated that the power to regulate slavery was given to the federal because it wasn't expressly given to the states (this was directly against precedent -- people were upset at the lengths the courts went to to protect slavery and keep the South happy)
Non-citizens are not allowed to sue under the US court
Congress lacks power to prohibit or regulate slaver under Constitution (leave it up to the states)
