Marbury vs. Madison
(Marshall Court - 1803)
Marbury suing Secretary Madison over Jefferson's withholding of Adams' judicial appointment. Overturned the Judiciary Act of 1789, establishing the right of the Supreme Court to void any law that the Court deemed to violate the Constitution. "...an act of the legislature, repugnant to the Constitution, is void."
Dred Scott vs. Sanford
(1857)
2nd case where the Court used judicial review to declare an act of Congress unconstitutional (Missouri compromise). Ruled that slaves and free blacks were not citizens worthy of constitutional protection, and could be claimed as property.
Engel vs. Vitale
(1962)
Related to the Establishment Clause. Group of parents sued about school suggesting a student prayer (non-denominational) in the morning. Court ruled this act violated the Establishment Clause.
Epperson vs. Arkansas
(1968)
Evolution, creationism, and intelligent design in public school.
Ruled a ban on the teaching of evolution violates the establishment clause.
