What is primary legislation and secondary?

Primary legislation- it is acts of the parliament which takes months to go through each stage.


Secondary legislation- this is the framework that grants access for primary legislation, the regulations can be made quickly

What is done to make or change a law?

Green paper: it is a consultation document which Is put together by a government department, their aim is to stimulate discussion by putting forward ideas for future government policy.


White paper: this explains the government’s preferred future policy on the subject before it introduces legislation, and they gather feedback before presenting a bill to parliament.


Then a queens speech occurs every year which sets out the government’s proposals for legislation in the coming year, this proposed new law is then presented to parliament, at this stage it is known as a bill, this is passed through several stages in parliament before becoming an act of parliament (law).what is a crime

What is a crime?

Certain activities which are deemed unacceptable by government, this happens when a person intentionally commits a one of these activities or intentionally fails to do something required by criminal law. Medicines and Healthcare Products Regulatory Agency (MHRA) - they investigate medicine offences.

What does the cps do?

The cps prosecutes people accused of criminal offences in the criminal courts. They will only prosecute if they believe they have a reasonable chance of winning the case shown with sufficient evidence and also if it is in the public interest to do so,


minor cases - magistrates decide so it takes place in a magistrates court.


Serious cases - 12 person jury decides which takes place in a crown court.

What is the standard of proof for criminal law and what is the purpose for sentencing criminals?

Beyond reasonable doubt is the standard of proof required in a criminal court and it is to punish offenders, prevent them from doing the same action once again or to deter others from committing the same offence.

What are the crimes committed from a pharmacist?

Stealing prescription forms completed at the pharmacist and submitting them on his behalf of his business so he can receive payment from NHS-


COURT- sentenced him to a 12 month prison sentence suspended for 24 months and 200 hours of unpaid work. The suspended sentences is that the person would only have to go prison if a further crime was committed in 24 months.

What is civil law and what is the standard of proof for civil law?

It’s purpose is to regulate human relationships, protect invidiuals rights and provide compensation when rights are infringed, the claimant has to prove on the balance of probabilities ( standard of proof) that the defendant is responsible, civil law actions are not designed to punish or deter, just to correct problems and look after people as to where they were before in that state through compensation.

What example shows pharmacists involved in civil law?

One example of civil law could be negligence for a pharmacist, e.g a patient is supplied with the wrong medication which causes the patient to suffer, therefore the pharmacy could be sued for negligence

What is the purpose of the Medicines Act 1968?

It is to control the safety, quality and efficacy of medicinal products. It did this by means of a system of licenses and certificates. These regulate the entire process from the first clinical trials of a medicine through manufacture to supply to the patient. It requires a medicine to be safe, effective and produced to an appropriate quality.
