Every licensee shall display their license in a
conspicuous place at their primary work station.
A duplicate license shall be issued upon
the filing of a statement explaining the loss and paying the fee required.
A temporary license is
not available.
Every licensee shall notify the board of their new address,
within 30 days after a change of address.
All establishment licenses shall be posted in a
conspicuous place in the reception area.
Before use upon a person, all non–electrical instruments shall be clean with soap or detergent and water, rinsed and dried, then
totally immersed in an EPA–registered disinfectant with demonstrated bactericidal, fungicidal, and virucidal activity, used according to manufacturer's instructions and then rinsed and dried.
The disinfectant solutions shall remain
covered at all times, be clearly labeled and will be changed once a day or whenever visibly cloudy or dirty.
All instruments that have been used on a person or soiled in any manner shall be
placed in a closed receptacle labeled soiled, immediately after use.
All disinfected instruments shall be
stored in a closed receptacle labeled clean.
All instruments and supplies which come into direct contact with a patron and cannot be disinfected (for example, cotton pads, sponges, emery boards, and neck strips) shall be
placed in a closed waste receptacle immediately after use.
You are never permitted to carry any instruments/supplies
in or on a garment or uniform.
Every licensee performing services shall thoroughly wash his or her hands with soap and water or any equally effective cleansing agent
immediately before serving each person.
A person working or training in an establishment or school cannot massage any person upon a surface of the skin or scalp where such skin is
inflamed, broken (e.g., abraded, cut) or where a skin infection or eruption is present.
Towels shall be laundered either by regular commercial laundering or by a noncommercial laundering process which includes washing or rinsing in water at least
160 degrees for not less than twenty five (25) minutes.
All clean towels shall be stored
in closed cabinets.
All liquids, creams, and other cosmetic preparations shall be distinctly and correctly labeled to disclose their contents, kept in clean, closed containers, and
when only a portion of a cosmetic preparation is to be used on a patron, it shall be removed from the container in such a way as not to contaminate the remaining portion and pencil cosmetics shall be sharpened before each use.
In a salon/spa the application of electric current which causes muscles to contract, the application of topical lotions, creams, or other substances which affect living tissue, the penetration of the skin by metal needles, the abrasion of the skin below the non–living, epidermal layers and the removal of skin by means of a razor–edged instrument are
considered invasive procedures and therefore not allowed.
Licenses shall expire at
midnight on the last day of the month it was issued, every two (2) years.
A license which has not been renewed within five years following its expiration shall be deemed
canceled.
A suspended license means you can
not continue to engage in licensed activities a.nd is subject to expiration and needs be renewed by the licensee.
A revoked license may not be
renewed or reinstated.
An inspection can occur at
any time in which barbering, cosmetology, or electrolysis are being performed, during business hours and on Saturdays and Sundays as well as weekdays.
To take the Cosmetology exam, you must pay the exam fee and be not less than 17 years of age, completed the 10th grade in the public schools of this state or its equivalent
and complete a course in cosmetology from a school approved by the board, approved externship program or hold a valid license in another state.
Grounds for Immediate Suspension of licenses are
inadequate cleaning material for the proper disinfection and sanitation found on–site at the establishment, no pedicure cleaning logs, a history of repeated health/safety violations pertaining to manicuring or pedicuring equipment; or manicure/pedicure implements that are not visibly clean or pedicure foot spas, basins, or tubs that are not visibly clean.
The primary purpose of the State Board of Barbering and Cosmetology is
to protect the consumer.
Soiled towels must be
immediately placed in the soiled laundry container.
It is not ok to work in a salon
with an expired establishment license.
It is not ok for a licensee to work in a licensed establishment
if the licensee has an expired license.
An inspector can immediately close an establishment if
there is inadequate cleaning material for the proper disinfection and sanitation found on–site at the establishment, no pedicure cleaning logs, a history of repeated health/safety violations pertaining to manicuring or pedicuring equipment; or manicure/pedicure implements that are not visibly clean or pedicure foot spas, basins, or tubs that are not visibly clean.
Shampoo bowls and trays must
be cleaned with soap and water or other detergent after each shampoo.
In determining worker classification you must consider
who has financial control, behavioral control and relationship or intent of the parties.
If you become disabled, you may be eligible for State Disability
if you are an Employee.
Products that you buy for your business but use personally are
not deductible as an ordinary and necessary business expense.
If you can decide not to charge a client for a service or product
that is evidence that you have Financial Control.
Good record keeping requires
that you can substantiate (prove) all of the income and expenses.
When you are self–employed, you will need to make payments for Social Security, Medicare and Income (Self–Employment) taxes
quarterly.
If you pay the Salon a flat fee for Booth Rent
it is evidence that you have Financial Control.
If you get hurt at work, you can get Workman’s Compensation
if you are an Employee.
Reporting all your wages, including tips will
increase your Social Security Benefits.
If the Salon sets the prices that stylists charge then
it is evidence that the Salon has Financial Control.
If you believe that you have been underpaid as an employee
then you would file a complaint with the Department of Industrial Relations (Labor Board) to get your back pay.
If the Salon collects the money from the client and then pays you
it is evidence that the Salon has Financial Control.
If the Salon allows you to use whatever beauty products you want then
It is evidence that you have Behavioral Control.
If your employer is paying you commission instead of Minimum wage, it’s ok
only if your pay is more than Minimum Wage.
If the Salon allows you to set your own work schedule and you can come and go when you want
it is evidence that you have Behavioral Control.
If Salon Owner has you sign a Rental agreement that defines the Salon/Stylist relationship
and you have Financial and Behavioral Control, it would lean toward you being an Independent Contractor.
You did not file your income tax return on time
and you owe money, you will be assessed a failure to file penalty.
If something goes wrong with a client service then Malpractice Insurance is a good investment for
you if you are an Independent Contractor and the Salon Owner if it covers you as an employee.
If Salon offers a coupon or sale and you have to honor the discount, then
it is evidence that the Salon has Financial Control.
If Salon requires you to follow a “Dress Code”
it is evidence that the Salon has Behavioral Control.
As a personal service professional, the tips you receive from your customers are
fully taxable as income to you and must be reported.
If you want to find out if you would be classified as an Employee by the State Of California
then you would complete and submit form DE 1870 with the Employment Development Department.
If you want to find out if you would be classified as an Employee by the Federal Government
then you would complete and submit form SS–8 with the Internal Revenue Service Department.
If the Salon will not guarantee that you will make at least Minimum Wage
it is evidence that the Salon is not busy enough to support another Stylist and you should thank them for their time and look for work in another Salon.
If you are classified as an Employee then
you may be eligible for Unemployment Benefits.
