After leaving presidency John Adams made a document of who he wanted to be judges but some came so late they took until after he left office. Marbury the person that would put these documents into effect demanded these documents and Madison would not give them to him. James Madison, the new secretary of state would not give him these document and declared them invalid.
Marbury brought this as a suit to the judge John Marshall who declared it unconstitutional to be able to check the powers of government . It established (judicial review), the court's power to declare an act of congress unconstitutional. |
