What grounds are sufficient for an involuntary termination of the parent child relationship (8 grounds)?
|
The parent-child relationship may be involuntarily terminated if the court finds it in the best interest of the child to do so and one or more of the following grounds exists:
1. Neglect- parent knowingly placed or allowed child to remain in conditions/surroundings that endangered child's physical or mental well-being, 2. Abuse- parent engaged in conduct or knowingly placed child with persons who engage in conduct that endangers child's physical or mental well-being, 3. Parental misconduct- parent has refused to submit to court-order relating to child abuse, or parent has been major cause of child's failure to be enrolled in school or of child's long-term absence from home without consent and without intent to return, 4. Use of controlled substance in manner that endangers child- parent used controlled substance in manner that endangers health and safety of child AND failed to complete court-ordered substance abuse program, or if parent was cause of child being born with addiction to alcohol or controlled substance, 5. Failure to support for 1 year- parent fails to support child for 1-year period (BUT indigence may be a defense!), 6. Imprisonment for more than 2 years- parent knowingly engaged in criminal conduct that resulted in parent's imprisonment and inability to care for child for more than 2 years, 7. Other grounds- if parent either abandons child, abandons mother and fails to provide support knowing she's pregnant, commits sexual assault causing victim to become pregnant, was criminally responsible for death or serious bodily injury to other child, has been convicted of the murder of other parent, OR has mental/emotional illness or mental deficiency that renders parent unable to provide for child's physical, emotional and mental needs. |
