How to describe the grievance procedure?

Probationary procedure and guidance for uniformed staff (policy 480)
Disciplinary procedure - uniformed staff, fire and rescue staff and control staff (policy note 392a)
Disciplinary rules (policy note 481)
Grievance procedure - uniformed staff (policy note 394-)
Every employee is expected to adhere to the rules that are set out in these policy’s.

The three stages of formal discipline.

Formal stage 1

Formal stage 2

Formal stage 3

Explain the following terms in relation to discipline procedure: summary dismissal, unacceptable behaviour, suspension, criminal offences and representation.

Summary dismissal-

Acts which constitute gross misconduct are those resulting in serious breach of discipline.

Unacceptable behaviour- unauthorised absence, misuse of company facilities, poor time keeping.

Suspension- where you will not be allowed to work for a certain time period whilst investigations or hearings can take place. They may be asked to attend a hearing or meeting.

Criminal offences- if you have been charged with a criminal offence. This will be looked into to decide whether the alleged offence is serious enough for dismissal. And will the offence make you unsuitable for their type of work.

Representation- every individual has the right to be represented at each formal stage of the disciplinary procedure. The representative can be either a fellow employee or a trade union official, although no one is obligated to accept a request to represent someone. This includes investigation meetings, hearing and appeals whether they are full hearings or a review.

What is the appeals procedure?

There is an appeals procedure that allows individuals who have had disciplinary action taken against them (with the exception of action plans issued following stage 1 hearings for performance and attendance) to appeal after each formal stage of the disciplinary procedure.

Appeals must be made within 7 days of receiving written notice of the managers decision after the formal grievance hearing, you must make them in writing.
