Two Reasons Why A Pesticide Would Have Restricted Material Designation

(most pesticides are "general use")

  1. High toxicity or other serious human health hazards. Ex: high toxicity (Category I) insecticide
  2. Potential serious environmental impacts. Ex: low toxicity herbicide that is known groundwater contaminant/low toxicity herbicide that has a high potential for drift to adjacent crops.

Federal Vs. CA Restricted

  • Both EPA & DPR maintain lists of restricted pesticides.
  • All EPA pesticides are automatically designated by DPR as restricted.
  • DPR list may include some pesticides not restricted by EPA

For retail sale to & use only by certified applicator or persons under their direct supervision & only for those uses covered by the certified applicator's certification. Direct supervision for this product is defined as the certified applicator being physically present during applications, mixing, loading, repair & cleaning of application equipment. Commercial certified applicators must also ensure that all persons involved in these activities are informed of the precautionary statements.

Restricted Material Permits

Who issues permits?

  • Local CAC in accordance with DPR regulations
  • Generally issued for 1 calendar year.
  • May be issued for multiple years for permanent crops such as orchards or vineyards

Who are permits issued to?

  • Agricultural Operators - issued to property operator.
  • Non-Agricultural Permits - issued to property operator or pest control business

Can anyone obtain a permit?

  • Only certified applicators can receive a permit.
  • Applicators must hold QAC or QAL
  • Farmers obtain certification by taking exam offered by CAC not QAC or QAL

Can a permit be cancelled or suspended?

Yes. The permit can be cancelled or suspended by the county for violations of pesticide regulation laws or regs

Information Included In Restricted Material Permit

  • Name & contact info for permittee
  • list of all properties in the county where pesticides will be used
  • list of all crops/sites on which restricted pesticides will be used on each property
  • list of all the restricted pesticides to be used on each crop/site on each listed property
  • any conditions/restrictions on restricted pesticide uses on any crops or sites at listed locations

Site-Specific Factors of Permits

  • nearby schools, labor camps, residential areas
  • adjacent highways/roads
  • nearby waterways
  • sensitive environment sites
  • presence of threatened/endangered species or their habitats
  • adjacent crops

Restricted Material Permit Conditions

  • when pesticide applications can be made
  • which pesticides may be used near sensitive sites
  • application methods that may be used (i.e. - no aerial applications)

Dealer Requirements

  • Before selling a restricted pesticide dealer must obtain a copy of the permit from prospective purchaser
  • Must keep copies of restricted pesticide permits for a minimum of 2 years

Notice of Intent (NOI)

  • In order for permit to be date specific NOI must be given to CAC at least 24 hours before intended pesticide use
  • Can be submitted by: hand deliver, fax, telephone or email (discretion of commissioner)
  • Give commissioner the opportunity to inspect the proposed application site &/ application itself
