Process for Pesticide Registration

  1. Pesticide manufacturers (registrants) must submit scientific date to EPA & DPR to support registration.
  2. Data must include information on product chemistry, toxicology, environmental fate & efficacy data.***Expensive and can take years to complete.

Emergency Registrations

expedited registration for cases of economic & human health emergencies. Two types: SLN & Section 18.

SLN (Special Local Need)

  • type of emergency registration
  • can be authorized by states for emergency use of federally-registered pesticides

Section 18

  • type of emergency registration
  • required when the emergency involves a pesticide that does not have federal registration

DPR (Department of Pesticide Regulations)

Lead agency responsible for enforcing pesticide laws & regulations.

Not Considered Agricultural Pesticide Use

Pesticide Use Reporting

  • Pesticide uses required to be reported to CAC, who then reports to DPR.
  • Required to be reported on a monthly basis, except commercial applicators.
  • Commercial applicators applying pesticides to agricultural crops must make weekly reports

Pest Control Aircraft Pilot Certificate

  • two levels - apprentice & journeyman
  • apprentice - lower level & can take journeyman exam after one year of experience working under a journeyman & at least 150 hours in a fixed-wing aircraft &/ 50 hours in a non-fixed wing (helicoptor)

Pest Control Adviser License (PCA)

  • individuals who provide professional pest control advice in agricultural settings

Requirements of PCA

  • All recommendations must be in writing & copies kept for 1 year.
  • Copies of recommendations must be provided to operator of property, pesticide dealer & applicator before application
  • only DPR-issued license that requires a BA in agriculture, pest management or biology or at least 60 units & 2 yrs work exp as PCA assistant

Pest Control Dealer Designated Agent License (DA)

individuals who supervise the sale of pest control products by pest control dealerships

Business Licenses

Do not require a DPR exam, but do require a DPR-licensed individual to work for the business

Pest Control Business License

  • for commercial pest control companies (agricultural/non-agricultural)
  • businesses qualify for this license by having at least one person on staff with valid QAL

No Fee Business License

  • falls under regular pest control biz license
  • allows farmers to make pesticide applications tor neighboring farmers (neighbor's license)

Maintenance Gardener Business License

Companies that use pesticides, but only as an incidental part of their regular landscape maintenance business. (QAC required only)

Pest Control Dealer License

  • businesses that sell agricultural use or restricted use pesticide products.
  • must have QAL-holder, PCA, pilot or designated agent on staff

When Does DPR Require a Pest Control Dealer License?

  • sell pesticides for agricultural uses
  • sell any method or device for the control of agricultural pests
  • solicits sales of pesticides by making agricultural use recommendations through field representatives or other agents
  • sells restricted pesticides

Pesticide Broker License Criteria

  • the first to sell, offer to sell, distribute into, or bring into CA for sale any pesticide product.
  • AND you are not the registrant or a licensed pest control dealer.
  • Applied to ALL pesticide products, not just those for agricultural use

Pest Control Business Requirements

  • work comp insurance, liability insurance, bonded or certificate of deposit w/ DPR
  • county registration
  • equipment list identified & registered
  • notice to property operator (prior 2 treatment)
  • completion notice within 24 hrs (farming only)
  • copies of permits & recommendations
  • accident reports (report ASAP to CAC)
  • use records (maintain for 2 years)
  • used reports (submit to CAC)
