What was the role of police?
Early America- tax collectors, street sweepers, crime investigation, observation.
Today- Crime control, investigation, patrol, provide service to citizens.
The police mission
1. Enforce and support laws 2. Investigate crimes/arrest offenders 3. prevent crime 4. Ensure domestic peace 5. Provide community with enforcement.
Preventing Crime
Law enforcement's ability to prevent crime relies in part on their ability to predict crime. We are unaware of how effective we are in preventing crime. D.A.R.E is a way to try to prevent crime.
Proactive Activities
Crackdowns and Sweeps are when they target a certain group such as 16 and under for curfew; Selective Enforcement is dancing on the edge of racial profiling which is a problem; Aggressive Policing is focusing on probelm areas.
Broken Windows Thesis
A perspective on crime causation that holds that the physical deterioration of an area leads to higher crime rates and concern of safety for residents.
Police Personalities
Realists:cynical,can't change the world; Enforcer:order over rights,resent society, dissatisfied with jobs; Optimist:people oriented, rights over order,police improve society; Idealists:problem solver,order with rights, underappreciated.
Discretion
Discretion=Choice; Factors the influence choice: background of officer, suspects character, pressure from victim, disaggreement with law etc.
Brown vs. Mississippi and Tennessee vs. Garner
Police accused 3 men of rape, hung one by neck until confession, confession was unconstitutional; This came to police being able to use as much force needed just not over extended use. Garner was fleeing a scene and officer shot him in head, family pressed charges, dropped; Dropped cause he was suspected of committing a felony.
Misfeasance, Malfeasance, Nonfeasance
Mis: Fail to perform duty properly (profiling, no miranda rights)
Mal: Performing illegal act (taking bribes, using drugs)
Non: Fail to perform duty (see violation but don't do anything)
Police Corruption
2 types of corruption: grass eating and meat eating
Grass:Illegitimate activity; occurs time to time in normal course of police work; most common form; includes gratuities,minor bribes, intentional speeding
Meat:More serious form; active seaking illicit money-making;includes committing crimes, malfeasance, physical abuse.
Building Police Integrity
Police are trying to get rid of the "us vs. them" menatlity that police have; building trust with the public.
The Rampart Scandal
Occured in 2000, a number of officers were investigated on charges ranging from falsifying evidence to the theft and sale of illegal drugs, many criminal cases had to be dismissed.
The Mollen Commission
The New York Police Department revealed acts of corruption such as: beating innocent people,dealing drugs, stealing drug money, cover-ups, stifling investigations.
