The voluntary relinquishment of rights of ownership or another interest(such as easement) by failure to use the property, coupled with an intent to abandon(give up the interest).
Abandonment
A summary of the essential provisions of a court judgement, which when recorded in the county recorder's office, creates a lien upon the property of the defendant in that county, both presently owned or after acquired.
Abstract of Judgement
A compiliation of recorded instruments certified to reflect all recorded transactions affecting title to a particular tract of land.
Abstract of Title
To touch, border on or be contiguous to.
Abut
The right to enter and leave a tract of land. Often this will entail the right to cross over the lands of another party.
Access
The gradual addition to the shore or bank of a waterway. The land generally becomes the property of the shore or bank, except where the laws specify otherwise.
Accretion
A court action to establish ownership to real property. Although technically not an action to remove a cloud on title, the two actions are usually referred to as "Quiet Title" action.
Action to Quiet Title
(For the Suit); A guardian "Ad Litum" prosecutes or defends a suit for a minor or incompetent.
Ad Litum
Appointee of the court to administer the estate of a decedent where there is no will or appointment of a representative in a will.
Administrator/Administratrix
A claim to land arising from open, adverse and notorious use, in contest with prior recorded title ownership.
Adverse Possession
A statement signed and sworn before some person authorized to take an oath.
Affidavit
1)Relationship not of blood. Related by marriage.
2)Any group for a specific purpose is call an affinity group, such as clubs, people in the same school, etc.
Affinity
A substitution for an oath when a person objects to taking an oath(Quakers, atheists). A lie after an affirmation is still perjury.
Affirmation
Legal doctrine by which property automatically vests in a grantee when a grantor acquires title to the property after the deed has been executed and delivered.
