They have an unequal relationship and the Bourgeoisie exploit and oppress the Proletariats, which some may argue is a crime in itself.

#The Basis of the Criminal Law

Marxist analysis of criminal law - All laws essentially passed for benefit of ruling class, criminal law reflects their interests.


Example: Laws that concern property ownership benefit those who own large amounts of property.


Personal violence is dangerous, ruling class want to control violence in society through their agents - police/army.


Criminal Law operates to protect the rich and powerful.

1349 - 1/3 of the population killed because of Black Death ~ Those left could demand a higher wage ~ Left the Bourgeoisie annoyed ~ Vagrancy laws passed to ensure every able bodied man had to work for little pay.



1530 - Law adapted to protect powerful merchants ~ Punished potential highway men.

Hebdige*

Crime and Deviance can be seen as a sign of rebellion amongst the W.C.



East-End London ~ Homes destroyed + replaced by new buildings for profit (W.C cannot afford to re-purchase) ~ Hebdige argued that the houses represented the culture, past and future of the W.C.


W.C tried to resist destruction of culture ~ Took on sub-culture and adapted a new fashion (a fight against capitalism)

#Marxist Subcultural Theory

Only those groups on the margins of society are not 'locked in' by ideology and finance, thus are able to provide some form of resistance to capitalism.


The single largest group offering this resistance is W.C youth.

#Brake

A resistance is expressed through W.C youth subcultures.


The clothes they wear, the language they speak, shows their disdain of capitalism.

#Magical

Brake argues that the resistance is 'magical', it is an illusion that appears to solve their problems, but in reality it does no such thing.
