ARREST
|
An arrest is the taking of a person in to custody in a case and in the manner authorized by law.

CRIME
|
A crime is an act or omission forbidden by law, punishable upon conviction by death, imprisonment, fine, or other penal discipline.
|

PROBABLE CAUSE
|
Probable cause exists when the facts and circumstances known to the officer would warrant a prudent man in believing that a crime had been committed and that the accused had committed it.
|
|
REASONABLE SUSPICION
|
Facts or circumstances, which would lead a reasonable person to believe a crime has been, is being, or is about to be committed.
|
|
DE-ESCALATION
|
Officers should use advisements, warnings, verbal persuasion, and other tactics and alternatives to higher levels of force. Officers should recognize that they may withdraw to a position that is tactically more secure or allows them greater distance.

|
IMMINENT THREAT
|
Refers to an impending violent act or resistance that an officer reasonably believes will occur, based on the totality of the circumstances.
|
|
REASONABLE FORCE
|
Reasonable force is an objective standard of force viewed from the perspective of a reasonable officer, without the benefit of 20/20 hindsight, and based on the totality of the circumstances presented at the moment the force is used.

FELONY
|
Punishable by death or imprisonment in the state penitentiary.
|
|
GROSS MISDEMEANOR
|
Punishable by fine of not more than $2,000.00 or imprisonment in the county jail for not more than 1 year or by both fine and imprisonment.

MISDEMEANOR
|
Punishable by fine of not more than $1,000.00 or imprisonment in the city or county jail for not more than 6 months, or by both fine and imprisonment.

LOW LEVEL FORCE
|
A level of force or control which is neither likely nor intended to cause injury.
|
|
INTERMEDIATE FORCE
|
A level of force greater than low-level force which has potential to cause reasonable injury or substantial pain. But is neither intended nor likely to cause substantial bodily harm or death.
|
|
DEADLY FORCE
|
Deadly force is that degree of force, which is likely to produce death or serious bodily injury. Deadly force can also result from a force option being improperly applied.

|
ELEMENTS OF CRIME
|
In every crime or public offense there must exist a union or joint operation of act and intention, or criminal negligence.

INTENT
|
A state of mind in which a person seeks a particular result through a particular course of action.
|
|
BATTERY
|
Any willful and unlawful use of force or violence upon the person of another.
|
|
ASSAULT
|
Unlawfully attempting to use physical force against another person; or intentionally placing another person in reasonable apprehension of immediate bodily harm.
|
|
DEADLY WEAPON
|
Any instrument, which by its contemplated design or by the manner it is used, is readily capable of causing substantial bodily harm or death.
|
|
SUBSTANTIAL BODILY HARM
|
Any bodily injury which creates a substantial risk of death, causes serious permanent disfigurement, protracted loss or impairment of the function of any bodily member, organ or prolonged physical pain.

|
BURGLARY
|
Every person who, either by day or night, enters any structure with intent to commit grand or petit larceny, any felony, assault or battery, or to obtain money or property by false pretenses, is guilty of burglary.

INVASION OF THE HOME
|
Every person who, by day or night, forcibly enters an inhabited dwelling without permission of the owner, resident or lawful occupant, which involves any act of physical force resulting in damage to the structure, whether or not a person is present at the time of entry, is guilty of invasion of the home.

LARCENY FROM PERSON
|
The unlawful taking, from the person of another, without his consent, any money, property or thing of value, under circumstances not amounting to robbery.
|
|
ROBBERY
|
The unlawful taking of personal property from the person of another, or in his presence, against his will, by means of force or violence or fear of injury immediate or future.
|
|
SEXUAL ASSAULT
|
A person who subjects another person to sexual penetration, or who forces another person to make a sexual penetration on himself or another, against the victim's will is guilty of sexual assault.

STATUTORY SEXUAL SEDUCTION
|
Statutory sexual seduction means ordinary sexual intercourse, anal intercourse, cunnilingus or fellatio committed by a person 18 years of age or older with a consenting person under the age of 16 years.
