What is the purpose of the constitution?

- To set out the legal structure of parliament and its law making authorities

Facts and outcome of the Brislan case

-In 1905 the commonwealth parliament passed the wireless telegraphy act. Which was that all owners of wireless sets were required to have a licence


- R. V. Brislan was charged with having a wireless without a licence. She challenged the validity of the licence


- The court decided that a wireless was a ' like service'


Therefor the wireless telegraphy act was valid

1st strength of parliament as a law maker

Parliament has access to expert opinion - this is a strenth because gathering data from a wide variety of sources allows parliament to make informed decisions when making bills

2nd strength of parliament as a law maker

Consultation with the public- this is a strenth because parliament gives the public many ways to be involved with law making and allows the public to make proposals for laws

3rd strenth of parliament as a law maker

Law made by parliament is responsive and flexible- as society is changing, parliament can act quickly by introducing new laws in response to these changes

1st weakness of parliament as a lawmaker

Parliament is not always sitting- this is a weakness because having only 40-70 sitting days means thay delays will occur - so authorities make laws instead

2nd weakness of parliament as a lawmaker

The bicameral structure of parliament- the upper house can fustrate the lower house by not passing laws and demanding changes

Inconsistencies in statute laws between states- the rights of people vary depending on which state they live in - individuals can be confused
