How is an oral contract formed?

When someone makes an offer to do something in exchange for something else (consideration) and the other person orally agrees (acceptance)

In what situations can contracts not be formed?

Minors cannot consent to medical care unless they're imancipated, or if they live in a state that has statutory adult laws. Insane or mentally incompetent people cannot enter into contracts - a guardian or conservator must do so on their behalf.
