Business Entity

Business organization that has an ownership that includes any persons who are not licensed or certified to provide PT services in this state, that offers to the public professional services regulated by the Board that is established pursuant to the laws of any state or foreign country

General supervision

Supervising PT is on call and readily available via telecommunications when the PTA is providing treatment interventions

On-site supervision

Supervising PT is on site and is present in the facility or on the campus where assistive personnel or a holder of an interim permit is performing services, is immediately available to assist the person being supervised in the services being performed and maintains continued involvement in appropriate aspects of each treatment session in which a component of treatment is delegated

Who makes up the Board of PT?

To be licensed, an applicant educated outside of the US must: (9 things)

1. Be of good moral character


2. Complete application process


3. Provide evidence that education is substantially equivalent to requirements of PTs educated in accredited programs. Board may require that a person completes additional coursework.


4. Provide written proof of legal authorization to practice as a PT without limitation in country where they were educated.


5. Provide proof of legal authorization to reside and seek employment in US or its territories


6. Have passed the board approved English proficiency examinations if the native language isn't English


7. Have participated in an interim supervised clinical practice period before licensure as approved by board, or have already met requirement by practice in another jurisdiction of the US.


8. Have successfully passed the NPTE


9. Have successfully passed a jursiprudence exam that tests knowledge of board statutes and rules.

To be licensed as a PTA, an applicant must: (5 things)

4. Attempting to engage in conduct that subverts or undermines the integrity of the examination or exam process.


5. Engaging in any conduct that would be considered a violation of section 32-2044 (grounds for disciplinary action)

Business entity must establish and implement a written protocol for the secure storage, transfer, and access of PT records. Must include, at minimum, procedures for:

1. Notifying pts of future locations of their records if the business entity terminates or sells the practice


2. Disposing of unclaimed PT records


3. Timely response to requests by pts for copies of their records

Business entity section does not apply to:

1. A sole proprietorship or partnership that consists exclusively of persons who are licensed by a health profession regulatory board


2. a facility regulated by the federal government or a state, district, or territory of the US


3. An admin of the estate of a deceased PT or person who is legally authorized to act for a PT who has been adjudicated to be mentally incompetent for not more than one year from the date the Board receives notice of the PTs death or incapacitation


4. a health care institution that is licensed pursuant to title 36

Failing to report to the board any direct knowledge of an unprofessional, incompetent, or illegal act that appears to be in violation of this chapter or board rules.

In lieu of disciplinary proceeding, the board may permit a person to actively participate in a board approved substance abuse recovery program if:

1. The board has evidence that the licensee/certificate holder is an impaired professional


2. The person has not been convicted of a felony relating to a controlled substance


3. The person enters into a written agreement with the board for a restricted license and complies with all of the terms of the agreement, including making satisfactory progress in the program and adhering to any limitations on the licensee's practice imposed by the board to protect the public. Failure to enter into such an agreement shall activate an immediate investigation and disciplinary proceedings by the board.


4. As part of the agreement established between the licensee or certificate holder and the board, the person signs a waiver allowing the substance abuse program to release info to the board if the person doesn't comply with the requirements of this section or is unable to practice with reasonable skill or safety.
