Intention

An act is intentional when it's done deliberately with full understanding of its consequences and with a desire to produce those consequences.

How does the court determine intention?

The court looks at all the surrounding circumstances and depending on the factors may presume intention by what is said and done. The law presumes that a person intends the natural and necessary consequences of his actions.

Negligence

Negligence occurs where a person does not desire the result but where he is reckless, indifferent or careless as to the result.
