Lochner v New York

5-4 decision, act was unconstitutional, conviction of Lochner was reversed. Hist right was protected by 14th amendmemnt. Under certain circumstances states can regulated certain employment contracts.

Weeks v U.S.

Unanimously overturned Weeks' conviction. Fruit of a poisoned tree. Violated rights, tainted evidence cannot be used in trial. First application of Exclusionary Rule.

Epperson v Arkansas

7-2 decion. Establishment clause had been violayed, law solely on bases of Christianity.

Everson v Board of Edication

4-5 vote. All parent s were reimbursed even parochial. Estab. Clause not violayed because money was linked to form if general public service.

Wolf v Colorado

US Supreme Court upheld Wolf's conviction, on saying evidence was still admissible in court.

Bowers v Hardwick

5-4 decision said constitution did not protect consensual sodomy by 4th amendment. Overruled by Lawrence v Texas

Hurley v IAGLB

Unanimous vote, violated the 1st amendment because parade organizers had right to out whoever in parade, broadened constitutionality of symbolic speech.

U.S. v Miller

Possession of sawed off double barraled shotguns is not protected by 2nd amendment.

Employment Division v Smith

6-3 vote for state of Oregon. Using illegal drugs for religious purposes were still illegal and state doesn't have to give unemployment. Religious motivation doesn't mean you can't follow the law.

Miranda v Arizona

5-4 decision with Miranda. Prosecution could not use confession in trial because police didn't inform him of his rights from 5th and 6th amendments. Miranda was still convicted.

UCR v Bakke

5-4 decision in favor of Bakke, state may constitutionally consider race, gender, but not main factor in admissions to create campus racial diversity.

Roe v Wade

7-2 decion. Violated 14th Amendment rights to privacy. States have right to make own laws regarding abortion. 46 states changed laws.

Goss v Lopez

5-4 decision. State violated students' Due Process by suspending them. Suspending can seriously affect their future. Students' records were wiped.

Hamdi v Rumsfeld

8-1 Hamdi lost, but judicial review was needed. No rights because he was deemed as an enemy combatant. Separation of oowers, ability to drain without Due Process. Ability of Exec. branch to limit jurisdiction of Judicial branch.

U.S. v Nixon

8-1 decision. Nixon tried to stop use of tapes in trial and refused to turn over tapes. Presidents exec. privilege is not absolute and must bend to 4th and 5th amendments.

Texas v Johnson

4-5 decision that burning flag was free speech and protected by 1st amendment. Just because someone finds offensive doesn't mean they can outlaw it.

Dredd Scott v Stanford

7-2 for Stanford. Scott was not citizen but propery, protion of Missouri Compromise was unconstitutional and violated the 5th amendment.

Plessy v Ferguson

7-1 vote for Ferguson. Separate but equal accommodations for white and colored everywhere. Included schools, buses, etc.

Katz v U.S

7-2 decision in favor of Katz. Did violate privacy. Conversation is protected from unreasonable search and seizure by 4th amendment. Wiretapping does not count as search.
