Documentation for Reactivation of an Inactive or Retired License

Documentation must be submitted that the applicant is licensed and in good standing in another state and has actively engaged in the practice of PT for 4 years. "ACTIVELY ENGAGE" meaning, the applicant has practiced at least 400 hours per year in the state in which the applicant maintained a license.

Exemption of Spouses of Members of the Armed Forces from Licensure Renewal

A licensee who is the spouse of a member of the Armed Forces shall be exempt from all renewal provisions for any period of time which the licensee is absent from the State of Florida due to the spouse's duties to the armed forces.

What is consultation?

What direct supervision?

Supervision of subordinate personnel performing actions subject to license pursuant. The licensed supervisor is immediately available. On-site Supervision means direct supervision.

What is general supervision?

Supervision of a PTA shall not require on-site supervision by the PT. The PT shall be accessible at all times by two-way communication in which the PT can respond to an inquiry and made readily available for consultation during the delivery of care and shall be in the same geographic location as the assistant

What is the definition when a physical therapist gives DIRECTION to a PT or PTA?

Confidentiality

PT or PTA will safeguard the confidentiality of information and require written consent from the patient or legally authorized representative prior to releasing information to a third party not involved in the actual care.

Falsifying Information

The PT or PTA shall not use, participate, or engage in the use of inaccurately recorded, falsifiy, or alter patients records

Determining Diagnosis

The PT shall be responsible for providing a referring practitioner or practitioner of record, with any information which will assist in the determination of an accurate medical diagnosis

Delegation

It is the responsibility of the PT to in the delegation of an appropriate task. The PT shall not delegate portions of the skilled physical therapy functions or tasks to any lesser trained health personnel other than the PTA

Treatment or Prior Assessment

The PTA can not initiate or change treatment without the prior assessment and approval of the PT

Acute care- Inpatient Hospital

The PTA can not provide treatment to a patient who is an inpatient in the hospital or in acute care unless that PT is readily available to provide consultation. (Direct Supervision)

Change in Medical Status

The PTA shall report all untoward patient responses change in medical status, inquiries regarding patient prognosis, or the discontinuation of any treatment procedure to the PT and the board certified orthopedic, physiatrist, or chiropractic physician.

Delivery of Care- Not Inpatient or Acute Care

The PTA can provide treatment to a patient who is not an inpatient in the hospital or who is not in acute care, PT shall be accessible at all times by telecommunication and shall be within the same geographic location as the assistant. (General Supervision)

Unlicensed Supportive Personnel

May be utilized to help in the treatment being provided but can only perform such acts under the direct supervision of a PT or PTA

General/On Site Supervision- Employment

The PTA employed by a certified Orthopedic physician, physiatrist, or Chiropractic physician, shall be under the general supervision of a PT. If the PTA is employed by any other than a board certified orthopedic physician, physiatrist, or chiropractic physician, shall be under the on-site (direct supervision) of the PT

Pathological conditions

In addition to the formal study requirements the PT must complete:

200 hours of testing human subjects under the direct supervision of a licensed physician or PT and also should be able to present evidence of having performed 100 tests on neurologically involved patients, with finding corroborate by a licensed physician or licensed PT who has previously met these qualifications

Medical records of Deceased PT or PTA

Each PTA engaged in practice, who maintains the responsibility for client/patient medical records, shall ensure that the executor, administrator, personal representative or survivor shall arrange to maintain those medical records in existence upon the death of the PTA for a period of 2 years from the date of the death of the PTA

Disciplinary Actions

Guilt of a crime that relates to the practice or the ability to practice- Misdemeanor: from a minimum of 6-months probation up to a year's suspension with conditions

License acted against in another jurisdiction

The action consistent with the disciplinary guidelines for the offense that would have been imposed had the violation occurred in the State of Florida

Positive Drug Screening

Having a positive drug screening will result in a fine of $500 and a minimum of two yearsof probation and referral for PRN evaluation, up to maximum of suspension of license for one year, followed by up to five years probation

Impaired Treatment Program

Veung terminated from or failing to successfully complete a impaired treatment problem will result in a minimum of suspension to revocation, a pending appearance before the board and demonstrated compliance with the impaired practitioners consultant.

Practicing on a delinquent, inactive, or retired license

Will result in a misdemeanor of third degree.

Address Change

Failure to notify the board or keep a current address or practice address on file will result in a fine of $250.00

Clinical Instructors

Clinical Instructors shall receive 1 contact hour for every 160 hours of clinical internship limited to a maximum of 6 contact hours per instructor per bienium

Courses sponsored by program in physical therapy at a college or university which provide curriculum for training

One credit hour is equivalent to one contact hour. Courses are sponsored or approved by the American Physical Therapy Association (APTA) and the Florida Physical Therapy Association (FPTA)

Exemption for licensees from continuing education requirements:

(1) involves long term personal illness or illness involving a close relative or person who the licensee is care giver.


(2) licensee can demonstrate that the required courses are not reasonably available


(3) other demonstrated economic, technological or legal hardship that substantially relate to the ability to perform or complete the continuing education requirements

Refusal of plan of care

A PT shall not implement a plan of care if in the PT judgment is contraindicated to the referring practitioner. The PT shall notify the referring practitioner that he is not going to follow the request and reasons for such refusal.

Written medical records

PT shall keep all written medical records justifying course of treatment of a patient including; initial assessment, plan of treatment, treatment notes, progress notes, examination results, test results, and discharge summary.
