Paralegal
a.k.a- legal assistant. A person with special education, training, or work experience who works under a lawyer's supervision on substantive legal work that the lawyer otherwise would do.
Conflict of Interest
Being in a position where one's own needs and desires could possible lead one to violate one's duty to a person who has a right to depend on one, or being in a position where one tries to serve two competing clients.
Retainer
(1)Employment of a lawyer by a client. (2)The specific agreement between a lawyer and a client who hired her. (3)The first payment by a client to a lawyer either for one specific case or so the lawyer will be available for unspecified future cases.
Breach of Contract
Failure, without legal excuse, to lice up to a significant promise made in a contract.
Legal Malpractice
Bad, incomplete, or unfaithful work done by a lawyer.
Petition
A written request to a court that it take a particular action. In some states, the word is limited to written requests made when there is no other side in a case, and in some states, it is used in place of the term complaint.
Complaint
(1)The first main paper filed in a civil lawsuit that includes, amont other things, a statement of the wrong or harm done to the plaintiff by the defendant, a request for specific help from the court, and an explanation of why the court has the power to do what the plaintiff wants. (2) Any official complaint in the ordinary sense (e.g., a complaint to the police about a noisy party.) (3) In criminal law, a format document that charges a person with a crime.
Court Clerk
A court official who keeps court records and other official files.
Court Reporter
A person who records court proceeding in court and later makes good copies of some of them.
Expert
A person possessing special knowledge or experience who is allowed to testify at a trial not only about facts (like an ordinary witness) but also about the professional conclusions he draws from the facts.
