Describe the source of environmental law across the three major branches of the federal government.

- Started with US constitution which limits the power of the federal Gov't, led to first enviro regs from states


Executive: executive orders, president signs laws, executive laws and treaties


Legislative: federal statutes, administrative rule-making, common law

kubasek and silverman argue that before 1970 the US did not have any sort of enviro policy. Referring to particular type of policy. what is the primary focus of the enviro policies adopted since 1970, and how does this differ from US policies related to enviro adopted 100 yrs ago?

- policies before the 1970's focused on the instrumental value of the environment as opposed to the intrinsic value. This means much of the policy revolved around natural development and the protection of human health from enviro threats.

Distinguish between intrinsic and instrumental valuing of nature.

- intrinsic: associates the value of nature with its inherent qualities, not what one can take out of it.


ex. animals should be valued because theyre alive


- instrumental: values nature according to what we can use it for


ex. trees make oxygen
