Logical Relevance
|
Evidence is ligically relevant if it has any tendency in reason to prove or disprove a disputed fact of consequence to the determination of the action.

Authentication - Chain of Custody
|
When real evidence that is not of the type easily recognized, or is capable of causing confusion or subject to tampering, the proponent of the object must present evidence of its chain of custody.

Best Evidence Rule
|
In order to prove the contents of a writing, the original must be produced unless it is unavailable.

Secondary Evidence
|
Where the best evidence rule is not applicable, the majority and CA jurisdictions prefer a copy of the original writing if available. The federal and minority view will accept any kind of secondary evidence including oral testimony.

Judicial Notice
|
A court may accept facts that are not reasonably subject to dispute and are capable of immediate and accurate determination without the necessity of formal proof.
