What is SEXUAL CONTACT?
Whether or not occurring with the consent of a person with whom such conduct is prohibited by law or rule. (5300.0100-Subp. 13A-C)
Sexual Conduct Criteria that is Prohibited
A.) Sexual intercourse, cunnilingus, fellatio, anal intercourse, or any intrusion, however slight, into the genital or anal openings of the body by any part of the therapist's body or by any object used by the therapist/ or any intrusion of the genital or anal opening of the therapist's body by any part of another person's body or by any object used by another person for this purpose; if agreed to by the therapist.
B.) Kissing of, or the intentional touching by the therapist of a person's genital area, groin, thigh, buttocks, or breast, or of the clothing covering these body parts.
C.) Same as B, but reversed to a person touching a therapist, but if the therapist agrees to the kissing or intentional touching.
** Sexual contact includes requests by therapist in A-C
** Does not include conduct in A-C that is standard medical Tx. of a patient.
What is SEXUAL HARASSMENT?
Unwelcome sexual advances, requests for sexual favors, sexually motivated physical contact or other verbal or physical conduct or communication of a sexual nature (5300.0100-Subp.14A-C)
When is it sexual harassment?
A.) When submission to that conduct or communication is made a term or condition (explicit or implicit) of obtaining "employment, public accommodations or public services, edu. or housing."
B.) Submission to or rejection of that conduct or communication by an Ind. is used as a factor in decisions affecting that ind.'s " ".
C.) That conduct or communication has the purpose or effect to substantially interfering with an Ind.'s " ", or creating an intimidating, hostile, or offensive employment, public accommodations, public services, edu., or housing environ.; and in the case of employment, the employer knows or should know the existence of the harassment and fails to take timely and appropriate action.
What is a SUPERVISEE?
An Ind. who is engaged in postgraduate, supervised experience under the direction of a supervisor.
What is SUPERVISION?
Taking full professional responsibility for training, work experience, and performance in the practice or MFT of a supervisee, including planning for and evaluation of the work product of the supervisee, and including face-to-face contact btwn the supervisor and supervisee.
What is a SUPERVISOR?
An Ind. who has met the requirements in part (5300.0160) and takes responsibility for the practice of the supervisee during a specific time to enable the supervisee to meet the requirements of licensing.
What is THERAPEUTIC DECEPTION?
A representation by a therapist that sexual contact or unethical conduct with the therapist is consistent with or part of the professional work with a client, student, or supervisee or former client, student, or supervisee.
What is a THERAPIST?
A licensee of the board.
What is VARIANCE?
Permission from the board to comply with a rule in a manner than that generally specified in parts 5300.0100-.0360.
LICENSE REQUIREMENTS (5300.0110) Subpart 1 & 2
1.) License required.
2.) Engaging in marriage and family therapy practice, defined.
LICENSE REQUIREMENTS:
Licensed Required
No person, other than those Inds. exempt in MN statues shall engage in MFT practice, advertise the performance of such services, or use a title or description denoting MFT without obtaining a license issued under MN Statue.
LICENSE REQUIREMENTS:
Engaging in MFT practice, defined.
An Ind. engages in MFT practice if the Ind. performs or offers to perform MFT or if the Ind. i held out as held out as able to perform such a service.
EXCEPTIONS TO LICENSE REQUIREMENT (5300.0120)
Those qualified Ind.'s of other licensed or certified professions or occupations who are performing services consistent with their training are exempt from 5300.0110-.0360 as long as they do not pose as a MFT or family counseling services. Those who qualify may advertise the performance of MFT services.
What are the REQUIREMENTS FOR LICENSURE?
A.) Complete the edu. requirements in MN statutes
B.) Being 18 years of age
C.) Complete the experience requirements in MN statues
D.) Provide evidence of meeting the requirements of MN statutes through endorsements from @ least 2 ind.s with the quallifications (licensed by the board or diff. state with equivalent requirements)
E.) Agree to conduct all pro. activities by the code of ethics 5300.0350
F.) Pass both parts of the examination (5300.0240) National and state
Educational Requirements; Determination of Equivalent (EVALUATION BY BOARD) Subp.1
The board will evaluate the applicant's transcripts, documentation from the edu. institution that describes substance and purpose of the academic training, accreditation and other pro. recognition of the edu. accrediting bodies, and any other info. the board feels necessary. ALL requested docs. must be sent directly from the edu. institution to the board.
Educational Requirements; Determination of Equivalent (DEGREES; COURSE WORK REQUIREMENTS) Subp. 2
The degree is accepted if it is from a regionally accredited institution, if the degree is in a related subject or field and has the following course work:
A.) 9 sem. hrs. in human develop., human behavior, personality, human sexuality, psychopathology including the assess. and diagnosis or mental illness and behavior-pathology.
B.) 9 sem. hrs. in MFT studies covering theories of fam. develop., theories of fam. function., family life cycle, sociology of fam., fam. under stress, contemporary fam. forms, fam. subsystem, and theories of MF interaction.
C.) 9 sem. hrs. in MFT covering communication, fam. psych., fam. therapy, methods of intervention, fam. assess., TX. planning, sex therapy, major theories of fam. therapy structural, strategic, transgenerational, experiential, object relations, contextual, and systems therapy.
D.) 3 sem hrs. covering research design, statistics, in MFT
E.) 3 sem. hrs. in pro. studies covering pro. socialization, pro. org., legal issues, interpro. cooperation, pro. ethics, and family law
F.) Clinical practicum of 300 hrs, no more than 150 ind. client contact hrs. Must be on supervised site or academic institution by licensed LMFT or AAMFT approved supervisor.
** 4 quarter credit hrs. shall be equivalent to 3 credit hrs. in A-E. Curriculum may be completed during Masters or doctorate program; of additional course work may be taken at a accredited by a regionally accredited edu. institution after receiving degree in order to fulfill the requirements A-F.
** An applicant may not use a course for more than one are described in items A-F.
Educational Requirements; Determination of Equivalent Degree (PROOF OF EQUIVALENCY) Subp.3
The burden is on the applicant to prove by the preponderance of the evidence that the coursework is equivalent to the requirements in Subp. 2
Experience Requirements:
(SUPERVISED EXPERIENCE REQUIRED) Subp. 1
The 2 years supervised meet the requirements in 5300.0150 Subp. 2-6
Experience Requirements:
(YEARS OF EXPERIENCE COMPUTATION) Subp. 2
In calculating 2 yrs. of supervised postgraduate experience in MFT; the board shall accept a minimum of 1,000 hrs. of clinical client contact including assess., diagnosis, and Tx. of mental illness with 200 hrs. of supervision by a MN LMFT over a period of not less than 24 mths. All additional work used to complete this 2 yr. experience may be supervised in a legal and ethical manner by a licensed mental health professional.
Experience Requirements: (CLINICAL CLIENT CONTACT; REQUIREMENTS) Subp. 3
The applicant must demonstrate at least 500hrs. of clinical client contact in:
-unmarried couples
-married couples
-separating and divorcing couples
-fam. groups including children
*This contact shall include experience in the assess., diagnosis, and TX of mental illness.
Experience Requirements: (SUPERVISION; SETTING) Subp. 4
Supervision by a MN LMFT shall take place in Ind. or group settings according to:
A.) Ind. supervision shall take place in a setting in which a supervisor and not more than 2 supervisees present.
B.) Group supervision shall take place in a setting with a supervisor and no more than 6 supervisees present.
Experience Requirements: (SUPERVISION REQUIREMENTS) Subp. 5
Supervision must involve:
A.) at least 200 hours face-to-face contact btwn the supervisor and supervisee of which at least 100 must be Ind. settings
B.) 100 hours per supervision year
C.) A focus on raw data from the supervisee's clinical work that is made directly available to the supervisor through means of written clinical materials, direct observation, and audio or video recordings.
Experience Requirements: (VERIFYING SUPERVISED EXPERIENCE) Subp. 6
Supervisee must verify the required supervised experience by completing a form supplied by the board. Form must be signed by applicant's supervisor and be notarized. Form must include setting, nature, and extent of the supervised supervision, and the name and qualifications of each supervisor.
REQUIREMENTS FOR SUPERVISOR
Supervisor is acceptable to the board if the supervisor was listed before Jan. 19, 1999, except that those supervisors must meet the Continue Edu. requirements in 5300.0170D.
NEW supervisors are acceptable by board if supervisor:
A.) is a LMFT in MN
B.) Has @ least 3yrs. and 3,000 hrs. of experience in clinical practice as a LMFT
C.) Provides evidence of training in supervision. Evidence must be shown through graduate level coursework in supervision equivalent to 3 sem. hrs. for a regionally accredited institution or 30 hrs. in continuing edu. or designation by the AAMFT as an approved supervisor.
RESPONSIBILITIES OF SUPERVISOR
A supervisor must:
A.) be knowledgeable of clinical skills required for effective delivery of MFT services.
B.) be knowledgeable of all important literature in the field of MFT and pro. ethics, and the supervisor must be knowledgeable about the basic skills and service delivery of supervision.
C.) See all supervised work is conducted in appropriate pro. settings, with adequate administrative and clerical controls.
D.) Devote at least 10% of the required continuing edu. hrs. to supervision
LICENSURE PROCESS FOR LICENSURE ASSOCIATE MARRIAGE AND FAMILY THERAPIST
A LAMFT is one who has completed the edu. requirements and passed the written examination. LAMFT must practice underneath a supervisor approved by the BMFT. LAMFT must abide by same rules and laws that govern the practice of LMFTs. LAMFT status shall be granted for one year upon completion of the board's application form and payment of the required fee. LAMFT status may be renewed on a yearly basis for up to 4 additional yrs.
LICENSURE PROCESS FOR LICENSURE MARRIAGE AND FAMILY THERAPISTS
Process for licensure by the board as a MF therapist is divided into 2 parts: admission to written examination and admission to licensure
Procedures for Admission to Written Examination: (INFORMATION REQUIRED)
Subp. 1
To be admitted to written exam applicant's must submit to the board A-D:
A.) Must submit a completed, notarized application for admission to a written exam on a form provided by the board. Application must include affirmation by the applicant that the statements made are true and correct to the best of the knowledge of the applicant.
B.) Must submit required, nonrefundable fee for application admission to written exam, made payable to the BMFT.
C.) Must submit official transcripts of all graduate edu., including verification of the degree granted. Must be sent directly to the board from the granting institution.
* Applicant must demonstrate to the board, by preponderance of the evidence, that the degreed program documented by the transcripts meet the requirements of completion of edu. requirements.
*Institution must be regionally accredited at the time the degree was granted.
Procedures for Admission to Written Examination: (VERIFICATION OF INFORMATION; BOARD'S POWER) Subp. 2
The board has the authority to investigate or contact persons the authenticity of the info. in the applicant's for admission to the written exam and to require the applicant to provide verification.
Procedures for Admission to Written Examination: (TIME REQUIREMENTS) Subp. 3
The applicant's file shall be closed if the applicant fails to complete the application for admission to written exam. and provide all info. required with 6 mths. from the date the board receives the application.
Procedures for Admission to Written Examination: (ADMISSION TO THE WRITTEN EXAMINATION) Subp. 4
An applicant shall be admitted to the 1st regularly scheduled written, objective part of the exam. that occurs 60 days or more after the applicant has met the requirements of info. required, UNLESS admission is denied. Admission is complete after receipt by the board from the applicant of exam. fee.
Procedures for Admission to Written Examination: (DENIAL OF ADMISSION TO WRITTEN EXAMINATION) Subp. 5
Denial can happen to applicant of the edu. requirements have not been met. Board shall notify in a written denial and state the reasons for denial. An application after denial is a new application for admission and must be accompanied by with the fee payment.
