Consultation
use of a specialist in a particular area to help with a work-related problem. Consultation usually occurs as needed (ad-hoc) & always has a problem-solving function. Consultants do NOT have administrative authority. Consultees are free to reject the suggestions
Ethical Complaint Process
four stages--Inquiry, Investigation, Adjudication, & Appeal
Adjudication 6 levels of sanctions
advise--inappropriate, but not clearly unethical behavior
warn--behavior unethical & must cease
reprimand--behavior unethical & psychologist should have known better, but consequences minor
Censure--harm has occurred & actions are deliberate or persistent
time limited resignation--behavior both unethical & harmful. Psychologist must reapply to be re-instated
expulsion--offense so injurious & severe & the member is deem unrehabilitatable
fact witness
legal term; testifies about facts relevant to the particular case
expert witness
witness who can offer an opinion ro conclusion
insanity
legal term refers to a defendant's ability to distinguish between right & wrong
malpractice
negligent failure, resulting in harm to the client, to meet the duty to a client that arises out of a professional relationship
privacy
the right of an individual to pick & choose the time, circumstance, & extent to which he/she wishes to share with or withhold from others his/her attitudes, beliefs, behavior, & opinions. Particularly relevant in employment selection
privilege
legal term referring to the statutory right which protects the client from having his/her confidences revealed during judicial proceedings w/o his/her permission. The client is the "holder of the privilege" meaning that only he/she (or parents) has the right to waive it, except in certain legally defined circumstances.
supervision
function concerned with seeing that the quality of psychological services meets acceptable standards. supervision occurs on a continuous basis & is focused on the general work-related activities of the supervisee. A supervisor has administrative authority over subordinates.
Tarasoff
legal case Tarasoff v. Regents of UC
CA Supreme Court ruled that when a psychotherapist's client makes a serious threat of physical violence against an identifiable victim, the therapist must take reasonable care to protect the victim.
