Scope of Practice:
Standard of care:
Scope of practice is a set of regulations and ethical considerations that defines the extent or limit of EMTs job.
Standard of Care: the care that would be expected to be provided by an EMT.
Consent:
Expressed Consent:
Implied Consent:
In loco parentis:
Consent: Permission from the patient for care or any other action.
Expressed Consent: consent given by an adult of legal age and mentally competent to make a rational decision.
Implied consent: consent presumed of a patient or patient's guardian if could get it. For unconscious adult or child who's parent could not be contacted.
In Loco Parentis: in place of parents, a guardian indicated by parents (ex daycare workers).
In order for a patient to refuse care....
1) Patient must be legally able to give consent.
2) Must be mentally competent or orientated
3) Patient must be fully informed
4) Patient will be asked to sign a 'release' form

For negligence to be proved:
1. that there was a duty to act
2. that the standard of care was not met
3. that there is proximate causation- the damages to the patient were the result of the action/inaction of the emt.

Duty to act: obligation to provide emergency care to patient.
Abandonment: leaving a patient after care has been initiated, or passing off patient to a person with a lower certification.
