- does not apply to attempts, only to completed crimes

- applies to any felony in NC what is committed or attempted with a deadly weapon
- merger rule - felony must be independent of the killing
- Res Gestae principle - killing must take place during the felony or during immediate flight from the felony. (Once the felons reach a place of temporary safety) the felony ends
- the death must be foreseeable
- the victim must not be a co-felon
What is the agency theory?
the felony murder doctrine applies only if the killing is committed by one of the co-felons
Is the defedant liable for the death of a co-felon under felony murder doctrine?
No. Not if killed by the police or the victim
What is second degree murder in NC?
unlawful killing of a human being with malice but without premeditation and deliberation
What is voluntary manslaughter in NC?
a killing committed intentionally
in the heat of passion
upon adequate provocation
What are the requirements for voluntary manslaughter?
1) the provocation must be objectionably adequate, which means is would arouse a sudden and intense passion in the mind of a reasonable person.
2) the D was actually provoked (subjective)
3) D did not have time to cool off
4) D did not actually cool off between the provocation and the killing
What are examples of adeuate provication in NC?
1) serious assault or battery
2) presently witnessed adultery
3) unlawful restraint

1) a killing committed during the commission of a crime to which the felony murder doctrine does not apply
