What is Criminal Code Procedure 552?
Pleas at the arraignment. Arraignment is a formal reading of a CRIMINAL charging document in the presence of the defendant to inform the defendant of the charges against him. Takes place 48 hours after an arrest and 72 hours if individual was arrested on weekend. The four pleas to the indictment at the arraignment are guilty, not guilty, not guilty by reason of insanity and Milo contenders.
What is Criminal Code Procedure 671?
Grounds for recusal of a judge. A judge shall be recused when he is biased, biased, prejudiced, or personally interested in the cause to such an extent that he would be unable to conduct a fair and impartial trial. The judge shall be recused if is the spouse of the accused, of the party injured, of an attorney employed in the cause, or of the DA. The judge shall be recused if he or she is a witness in the cause, has performed a judical act in the case in another court, or for any other reason that he would be unable to conduct a fair and impartial trial.
What is Criminal Code Procedure 673?
Judge may act until recused. A judge has full power and authority to act even though a ground for recitation exists, until he is recused or a motion for his recitation is filed. The judge to whom the motion to recuse is assigned shall have full power and authority to act in the cause pending the disposition of the motion to recuse.
