Conspiracy (3)

An agreement between two or more persons


An intent to enter into an agreement; and


An intent to achieve the objective of the agreement




(Need overt act, preparation not enough)

Support Conviction of Conspiracy

1. There was a conspiracy with an illegal purpose;


2. The D was aware of the conspiracy; and


3. The D knowingly became a part of it.

Renunciation (Conspiracy)

Occurs if actor thwarted the success of the conspiracy under complete voluntary circumstances. (Jurisdictions split as to whether they allow this defense)



Abandonment (Conspiracy)

D has to tell all co-conspirators that he's abadoning and abandonment only works for future events (Still liable for crimes before date of abandonement)

Accomplice Liability

1. Provide some assistance in the commission of the offense by the primary violator (the principal) and;


2. Act with the requisite intent for the required offense.
