What is a drug?
- recognized in the official USP, HPUS or NF or any supplement to any of them,
- intended for use in the diagnosis, cure, mitigation, treatment, or prevention of disease in man or other animals,
- intended to affect the structure or any function of the body of man or other function of the body of man or other animals
What is a medical device?
Same as drug PLUS:
- does not achieve any of its primary intended purposes through chemical action within or on the body of man or other animals, and
- not dependent upon being metabolized for the achievement of any of its primary intended purposes
Adulterated drug
- filthy, putrid, or decomposed substance
- prepared, packed, or held under unsanitary conditions whereby it may have been contaminated
- does not conform with current good manufacturing practice
- Container is composed of any poisonous or deleterious substance
- Contains, for purposes of coloring only, a color additive which is unsafe
- a drug in an official compendium and strength differs from, or its quality or purity falls below, the standards in the compendium
- strength differs from, or its purity or quality falls below that which it represents.  
- mixed or packed with any substance to reduce its quality or strength or the drug has been substituted
Misbranded drug
- False or misleading label;
- Label does not contain all required information;
- Required label information is not prominently placed and not in terms likely to be read and understood by the ordinary individual under customary conditions of purchase and use;
- Drug name is in an official compendium (USP/NF) and it is not packaged and labeled as per compendium
- Container is so made, formed, or filled as to be misleading; is an imitation of another drug; or offered for sale under the name of another drug.
- Dangerous to health when used in the dosage or manner or with the frequency or duration prescribed, recommended, or suggested in the labeling;
- Packaging or labeling in violation of Poison Prevention Act
