Establishment Clause

Heckler's Veto

Political speech cannot be banned because it is distasteful or might result in a violent response.

Probable Cause

Police can search your automobile or effects if there is reasonable suspicion that illegal activity has occured. Does not apply to the home.

Double Jeopardy

Forbids government from prosecuting someone more than once for a crime where one has already been either convicted or acquitted.

Habeas Corpus

Defendant must be informed of charges against them and allowed to question a judge about why they are being detained.

Main function is to make laws and appropriate government funds.

Establishes the powers and responsibilities of president and bureaucracy.



Main function is to implement and enforce laws passed by Congress.

Judicial Function



Main function is to interpret the meaning of laws and whether they are consistent with the Constitution.

Due Process

All defendants get the same rights and process regardless of race, wealth, or appearing guilty.

Stare Decisis

Judges are required to decide cases based on how the Supreme Court or other judges have decided similar cases (precedents)
