Civil Disputes

A dispute between two private parties (persons, businesses, government.) May or may not involve


-laws or regulations


-contracts or agreements


- civil court orders

Criminal Dispute

A dispute between State ( or government agency for the people) and a private person or organization involving a breach if criminal law.


-Criminal laws or regulations ( Colorado Revised Statues) must be involved.

Liens

Evictions:


- landlord must follow eviction process through the court process.


- If person pays "rent" in any form, they are a tenant, no matter who is on the lease or mortgage.


-Includes adult children living with parents.

Restraining Orders

Modern restraining orders, both civil and criminal, list out very specific requirements for the restrained party. (Distances, behavior, use of alcohol, Etc.)

Child Custody Dispute

You have no authority to make decisions for the child, unless:


-there is a court order dictating information about the child.


-there is imminent danger to the health of the child.

Repossessions

Two types


1.) Vehicles


-no court order requirement.


-usually part of the initial contract.


-personal property must be returned.


-can be taken from driveways or public areas.


2.) Other tangible property


-requires court order.

Bail Bondsman

Rarely ask for help unless in trouble.


-investigate like you would any case. If criminal, act accordingly.


-avoid involvement if you can, otherwise maintain the peace.

Conflict Resolution- Mediation

-Use of neutral 3rd party to help others reach an agreement.


-Allow someone to save face. Graceful retreat.

Conflict Resolution- Negotiation

-Conversation between two or more people with the intent to reach an understanding or outcome.

Conflict Resolution- Counseling

-Also known in law enforcement as education. Educating someone on what is legal or what options they have.
