Congress can pass a law, but then president can veto, but if congress has a 2/3 vote,they can override it. BUT then the Supreme court can ultimately decide if its constitutional BUT the president elects the justices BUT the senate must approve

the power courts have to declare laws and actions of local, state or national governments if invalid if they violate the Constitution.
