4th Amendment

Right of persons to be secure in their persons, houses, papers and effects, against unreasonable searches+seizures. Shall not be violated and no warrants shall issue but upon probable cause, particularly describing the place to be searched, person or things to be seized. Also protection against Government intrusion, they need permission to search anything.

5th Amendment

Protection against erroneous charges through use of grand jury, double jeopardy; protection from self incrimination, due process of law. Timely manner of collection, and how to be careful, as to how to collect evidence.

Katz v. United States (1967)

Searches are restricted whenever individuals have a reasonable expectation of privacy. During a phone conversation in a public phone booth, the Supreme Court ruled that the 4th Amendment protects people not places, so for eves dropping took place at phone booth was NOT an issue.

6th Amendment

Speedy and public trial, jurisdiction responsible for the investigation; confront witness against him and obtain witness fro him. Miranda rights were put into Bill of Rights. Imparcial jury, informed of charges have proper jurisdiction in place. The right to counsel is being informed for defense. Identification of crime scene-who is going to process, is it going to be a single or multiple departments.

Arrest

When a person is taken into custody for the purpose of prosecution or interrogation.
