Jacobson v. Massachusetts
Case: Jacobson refused to comply with mandatory small pox vaccine
Decision: Court held that state's interest in public's health is important enough to restrict individual freedom. State's may "enact health laws of every description". State's have authority to protect the public's health "by all reasonable means"
Lochner v. New York
Case: NY statute set limits on maximum work hours for bakery workers.
Decision: supreme court struck down state statute/NY law ruled unconstitutional. Held that state's interest infringed on individual's right to establish business contracts.
Commonwealth v. Alger
Case: Alger built a wharf into Boston Harbor, MA law prohibits wharves beyond a certain distance
Issue: MA said this was a public hazard, Alger claimed he was not causing any harm
Decision: Supreme court upheld MA statute, supports concept of community good even withouth specific injury.
Griswold v. Connecticut
Case: Planned Parenthood of CT opened family planning clinic, CT had state law prohibiting dissemination of contraceptive info, executive director and medical director were arrested for advising a married couple concerning contraceptives
Issue: individual right to privacy
Decisions: CT law unconstitutional, "zones of privacy" were created, states had no special interest.
Eisenstadt v. Baird
Case: Baird gave lecture on birth control, exhibited contraceptives and then distributed them
Issue: did zone of privacy include single individuals?
Decision: MA law struck down, recognized privacy as a "fundamental right"
Roe v. Wade
Case: single woman in TX sued the state for making abortion a felony
Issue: whether state's concerns overrode the individual's right to privacy
Decison: the state must show "compelling interest to interfere with zone of privacy", state laws prohibiting abortion in the 1st and 2nd trimester ruled unconstitutional
Doe v. Bolton
Case: Mary Doe challenged GA law setting restrictions and conditions on legal abortions
Issue: whether added conditions like these imposed on a legal abortion were constitutional
Decision: GA law unconstitutional, abortions no different than any other surgical procedure
Bowers v. Hardwick
Case: Hardwick violated GA statute on sodomy (no gay sex).
Issue: was testing the broadening of the zone of privacy
Decision: GA law upheld as constitutional, narrowed the zone of privacy
Lawrence v. Texas
Case: same situation as Bowers v. Hardwick (Texas sodomy law)
Decision: Supreme court overturned Bowers v. Hardwick, homosexual relations was within the zone of privacy
Webster v. Reproductive Health Services
Case: MO statutes set obstacles to discourage abortions, state funds could not be used for legal abortions
Issue: right of states to impose obstacles to privacy
Decision: state law did not interfere with privacy, state could restrict how state funds were used
