FORMED OPINION AND THEN DID NO WORK -- WAITED UNTIL CASE WAS "OLD" AND THEN -- WITHOUT ACTUAL EVIDENCE, TOOK "OLD" CASE TO TRIAL - knowing that Brian would be at a severe disadvantage.
