Letter of Deviation

COPT may authorize a deviation from any rule in (33 CFR 164) if he determines the deviation does not impair the safe navigation of a vessel and will not result in a violation of the rules for preventing collisions at sea.
When should COPT require a vessel exam prior to issuing a LOD?
For vessels at a high risk from a safety perspective. (i.e. vessels w/ history of safety-related deficiencies/detentions or repeated LOD requests).
Control actions

The COPT shall institute appropriate control actions to safeguard the port, personnel, and the environment, when "clear grounds" exists and/or when a vessel arrives from a port that doesn't maintain adequate anti-terrorism measures.
Clear grounds


Evidence that the vessel, its equipment, or its crew do not comply substantially to the requirements of the relevant conventions, rules, and U.S. supplement, or that the master or crew members are not familiar with essential shipboard procedures relating to vessel safety or pollution prevention.

Commercial Vessel Compliance




Develops and maintains policy and standards for the prevention activities of the CG.

What is the purpose of the PSC program?


Verifies that foreign flagged vessels operation in U.S. waters comply with applicable international conventions, U.S. laws and regulations.




Focus on vessels most likely to be substandard in effort to reduce deaths/injuries, loss of property, and disruptions to marine commerce.




The goal is to identify and eliminate substandard ships from U.S. waters.

COTP

A tool to protect the safety and security of the port. COTP may use this order to implement a variety of control actions, including controlling the vessels movement as it enters/departs the port. May also use to expel a vessel out of a port. There are civil and criminal penalties for violating a COTP.
