Judiciary Act of 1789
a landmark statute adopted on September 24, 1789 in the first session of the First United States Congress establishing the U.S. federal judiciary. Article III, section 1 of the Constitution prescribed that the "judicial power of the United States, shall be vested in one supreme Court," and such inferior courts as Congress saw fit to establish. It made no provision, though, for the composition or procedures of any of the courts, leaving this to Congress to decide.
Report on Public Credit
The First Report on Public Credit was the first of three major reports on economic policy issued by American Founding Father and first United States Treasury Secretary Alexander Hamilton on the request of Congress. The report analyzed the financial standing of the United States of America and made recommendations for the retirement of the national debt. Commissioned by the House of Representatives on September 21, 1789 and presented January 9, 1790, this 140,000-word document was the first proposed federal assumption of debt owed by the states.
Report on Manufacturers
The Report on Manufactures is the third report, and magnum opus, of American Founding Father and 1st U.S. Treasury Secretary Alexander Hamilton. It was presented to Congress on December 5, 1791 and recommended economic policies to stimulate the new republic's economy and ensure the independence won with the conclusion of the Revolutionary War in 1783.

Hamilton's "Report on Manufactures" laid forth economic principles rooted in both the Mercantilist System of Elizabeth I's England and the practices of Jean-Baptiste Colbert of France. The principal ideas of the "Report" would later be incorporated into the "American System" program by Senator Henry Clay of Kentucky and his Whig Party. Abraham Lincoln, who called himself a "Henry Clay tariff Whig" during his early years, would later make the principles outlined in the "Report" and furthered by Clay's "American System" program cornerstones, together with opposition to the institution and expansion of slavery, of the fledgling Republican Party.

Hamilton's ideas formed the basis for the American School of economics.
Jay’s Treaty
a treaty between the United States and Great Britain that is credited with averting war,[2] resolving some issues remaining since the Treaty of Paris of 1783, which ended the American Revolution,[3] and allowing ten or more years of mostly peaceful trade between the United States and Britain in the midst of the French Revolutionary Wars that had begun in 1793. Historian George Herring pointed to the "remarkable and fortuitous economic and diplomatic gains" produced by the Jay Treaty.[4] The terms of Jay's Treaty were designed primarily by the first Secretary of the Treasury, Alexander Hamilton, strongly supported by the chief negotiator John Jay; but with only reluctant support from President George Washington.

The Jay Treaty was hotly contested by the Jeffersonians in the United States, but it was ratified by a 2/3 majority of the Senate of the United States. Jay's Treaty became a central issue of contention —leading to the formation of the "First Party System" in the United States. Jay's Treaty was signed in November 1794, and was officially ratified by both countries and proclaimed to be in effect on February 29, 1796.


The Jay Treaty, 1794.The Jay Treaty increased trade between the countries, and it averted another war—until 1812. This pleased both sides. Jay's Treaty gained the primary American goals, which included the withdrawal of units of the British Army from pre-Revolutionary forts that it had failed to relinquish in the Northwest Territory of the United States (the area west of Pennsylvania). (This area the British had recognized as American territory in the Treaty of Paris of 1783.) It was also agreed that disputes over wartime debts and the American-Canadian boundary were to be sent to arbitration —one of the first major uses of arbitration in diplomatic history. The Americans were also granted some rights to trade with British possessions in India and colonies in the Caribbean in exchange for some limits on the American export of cotton.

The treaty immediately became the central issues in domestic American politics, with Thomas Jefferson and James Madison leading the opposition. They feared that closer economic ties with Britain would strengthen the Federalists and undercut republicanism. The First Party System now emerged as voters were organized into two competing parties.

The treaty did encourage trade between the two nations for nearly a decade —but it broke down after 1803. The main tenets of the treaty were to expire after 10 years. Efforts to agree on a replacement treaty failed (in 1806) when Jefferson rejected the Monroe-Pinkney Treaty as tensions escalated towards the War of 1812.[5]
John Jay
an American politician, statesman, revolutionary, diplomat, a Founding Father of the United States, and the first Chief Justice of the United States (1789–95).

Jay served as the President of the Continental Congress from 1778 to 1779. During and after the American Revolution, Jay was a minister (ambassador) to Spain and France, helping to fashion United States foreign policy, and to secure favorable peace terms from Great Britain (with Jay's Treaty of 1794) and the First French Republic. Jay also co-wrote the Federalist Papers, along with Alexander Hamilton and James Madison.

As a leader of the new Federalist Party, Jay was the Governor of New York State from 1795 to 1801, and he became the state's leading opponent of slavery. His first two attempts to pass laws for the emancipation of all slaves in New York failed in 1777 and in 1785, but his third attempt succeeded in 1799. The new law that he signed into existence brought about the emancipation of all slaves there before his death in 1829.
Implied Powers
The Necessary and Proper Clause (also known as the Elastic Clause, the Basket Clause, the Coefficient Clause, and the Sweeping Clause[1]) is the provision in Article One of the United States Constitution, section 8, clause 18:


“ The Congress shall have Power - To make all Laws which shall be necessary and proper for carrying into Execution the foregoing Powers, and all other Powers vested by this Constitution in the Government of the United States, or in any Department or Officer thereof.
It allowed the government to interpret the constitution to do things it deemed neccessary, so long as it helped the people
Judicial Review
the doctrine under which legislative and executive actions are subject to review, and possible invalidation, by the judiciary. Specific courts with judicial review power must annul the acts of the state when it finds them incompatible with a higher authority, it means this: such as the terms of a written constitution. Judicial review is an example of the functioning of separation of powers in a modern governmental system (where the judiciary is one of three branches of government). This principle is interpreted differently in different jurisdictions, which also have differing views on the different hierarchy of governmental norms. As a result, the procedure and scope of judicial review differs from country to country and state to state.
Strict Construction
In the United States, Strict constructionism refers to a particular legal philosophy of judicial interpretation that limits or restricts judicial interpretation. The phrase is also commonly used more loosely as a generic term for conservatism among the judiciary.
Federalist Party
an American political party in the period 1787 to 1816, the era of the First Party System, with remnants lasting into the 1820s. The Federalists controlled the federal government until 1801. The party was formed by Alexander Hamilton, who, during George Washington's first term, built a network of supporters, largely urban bankers and businessmen, to support his fiscal policies. These supporters grew into the Federalist Party committed to a fiscally sound and nationalistic government. They also adamantly supported the annexation of Canada. The United States' only Federalist president was John Adams; although George Washington was broadly sympathetic to the Federalist program, he remained an independent his entire presidency.[1] The Federalist policies called for a national bank, tariffs, and good relations with Britain as expressed in the Jay Treaty negotiated in 1794. Their political opponents, the Democratic-Republicans, led by Thomas Jefferson and James Madison, denounced most of the Federalist policies, especially the bank, and vehemently attacked the Jay Treaty as a sell-out of republican values to the British monarchy. The Jay Treaty passed, and indeed the Federalists won most of the major legislative battles in the 1790s. They held a strong base in the nation's cities and in New England. The Democratic-Republicans, with their base in the rural South, won the hard-fought election of 1800; the Federalists never returned to power. The Federalists, too wedded to an upper-class style to win the support of ordinary voters, grew weaker every year. They recovered some strength by intense opposition to the War of 1812; they practically vanished during the Era of Good Feelings that followed the end of the war in 1815.[2]

The Federalists left a lasting imprint as they fashioned a strong new government with a sound financial base, and (in the person of Chief Justice John Marshall) decisively shaped Supreme Court policies for another three decades.[3]
Pinckney Treaty
also known as the Treaty of San Lorenzo or the Treaty of Madrid, was signed in San Lorenzo de El Escorial on October 27, 1795 and established intentions of friendship between the United States and Spain. It also defined the boundaries of the United States with the Spanish colonies and guaranteed the United States navigation rights on the Mississippi River. The treaty's full title is Treaty of Friendship, Limits, and Navigation Between Spain and the United States. Thomas Pinckney negotiated the treaty for the United States and Don Manuel de Godoy represented Spain. Among other things, it ended the first phase of the West Florida Controversy, a dispute between the two nations over the boundaries of the Spanish colony of West Florida.

The treaty was presented to the United States Senate on February 26, 1796 and after several weeks of debate was ratified on March 7, 1796. It was ratified by Spain on April 25, 1796 and ratifications were exchanged on that date. The treaty was proclaimed on August 3, 1796.

The Spanish, led by Manuel Godoy, were willing to negotiate with the United States, more from fear of a U.S.-British alliance which seemed imminent with the Jays Treaty of 1794. Less influential was the recently signed Treaty of Basilea which had ended the war between Spain and France.

By terms of the treaty, Spain and the United States agreed that the southern boundary of the United States with the Spanish Colonies of East Florida and West Florida was a line beginning on the Mississippi River at the 31st degree north latitude drawn due east to the middle of the Chattahoochee River and from there along the middle of the river to the junction with the Flint River and from there straight to the headwaters of the St. Marys River and from there along the middle of the channel to the Atlantic Ocean[1]. This describes the current boundary between the present states of Florida and Georgia and the line from the northern boundary of the Florida panhandle to the northern boundary of that portion of Louisiana east of the Mississippi. (The line ceases to be a border from the Pearl River to the Perdido River in order to provide the states of Mississippi and Alabama with seaports.)

This boundary had been in dispute since the British had expanded the territory of the Florida colonies while it was in their possession. They had moved the boundary from the 31st degree latitude northwards to a line drawn due east from the junction of the Yazoo River and the Mississippi, the present day location of Vicksburg, Mississippi. After the American Revolutionary War, Spain claimed the British border at the day of the Treaty of Paris while the United States insisted on the old boundary.

The treaty directed the United States and Spain to jointly survey the boundary line, and Andrew Ellicott served as the head of the U.S survey party. The treaty set the western boundary of the United States, separating it from the Spanish Colony of Louisiana as the middle of the Mississippi River from the northern boundary of the United States to the 31st degree north latitude. The agreement therefore put the lands of the Chickasaw and Choctaw Nations of American Indians within the new boundaries of the United States[2]. The United States and Spain agreed not to incite native tribes to warfare. Previously, Spain had been supplying weapons to local tribes for many years. Spain and the United States also agreed to protect the vessels of the other party anywhere within their jurisdictions and to not detain or embargo the other's citizens or vessels. The treaty also guaranteed navigation of the entire length of the river for both the United States and Spain. The territory ceded by Spain in this treaty was organized by the United States into the Mississippi Territory in 1798.
Whiskey Rebellion
The Whiskey Rebellion, less commonly known as the Whiskey Insurrection, was a resistance movement in what was the western part of the United States in the 1790s, during the presidency of George Washington. The conflict was rooted in western dissatisfaction with various policies of the eastern-based national government. The name of the uprising comes from a 1791 excise tax on whiskey that was a central grievance of the westerners. The tax was a part of treasury secretary Alexander Hamilton's program to centralize and fund the national debt.

The whiskey excise was unpopular among small farmers on the western frontier, where protesters used violence and intimidation to prevent government officials from collecting the tax. Resistance came to a climax in July 1794, when a U.S. marshal arrived in western Pennsylvania to serve writs to distillers who had not paid the excise. The alarm was raised, and more than 500 armed Pennsylvanians attacked the fortified home of tax inspector General John Neville. The Washington administration responded by sending peace commissioners to western Pennsylvania to negotiate with the rebels, while at the same time raising a militia force to suppress the violence. The insurrection collapsed before the arrival of the army; about 20 men were arrested, but all were later acquitted or pardoned.

The Whiskey Rebellion demonstrated that the new national government had the willingness and ability to suppress violent resistance to its laws. The whiskey excise remained difficult to collect, however. The events contributed to the formation of political parties in the United States, a process already underway. The whiskey tax was repealed after Thomas Jefferson's Republican Party, which opposed Hamilton's Federalist Party, came to power in 1800.
Alexander Hamilton
the first United States Secretary of the Treasury, a Founding Father, economist, and political philosopher.

Aide-de-camp to General George Washington during the American Revolutionary War, he was a leader of American nationalists calling for a new Constitution; he was one of America's first constitutional lawyers, and wrote most of the Federalist Papers, a primary source for Constitutional interpretation. Hamilton was the primary author of the economic policies of the George Washington Administration, especially the funding of the state debts by the Federal government, the establishment of a national bank, a system of tariffs, and friendly trade relations with Britain. He became the leader of the Federalist Party, created largely in support of his views, and was opposed by Thomas Jefferson and his Democratic-Republican Party. Jefferson denounced Hamilton as too loose with the Constitution, too favorable to monarchy and particularly to Britain, and too partial to the moneyed interests of the cities at home, but Hamilton's policies were generally enacted and Jefferson eventually saw the necessity of many of Hamilton's plans.[dubious – discuss] A believer in a militarily strong national government, Hamilton helped defeat the tax revolt of western farmers in 1794, and built a new army to oppose France in the Quasi War of 1798, but Federalist President John Adams found a diplomatic solution that avoided war. Hamilton opposed Adams, as well as the opposition candidates Jefferson and Aaron Burr, in the election of 1800; he supported Jefferson over Burr when the House of Representatives had to choose in an electoral tie between them. In 1804, tensions with Burr escalated to a duel, in which Hamilton was killed.

Born and raised in the Caribbean, Hamilton attended King's College (now Columbia University) in New York. At the start of the American Revolutionary War, he organized an artillery company and was chosen as its captain. Hamilton became the senior[2] aide-de-camp and confidant to General George Washington, the American commander-in-chief. After the war, Hamilton was elected to the Continental Congress from New York, but he resigned to practice law and found the Bank of New York. He served in the New York Legislature, and he was the only New Yorker who signed the U.S. Constitution. He wrote about half the Federalist Papers, which helped to secure ratification of the Constitution by New York and remain the single most important interpretation of the Constitution.[3] In the new government under President Washington he became Secretary of the Treasury.[4] An admirer of British political systems, Hamilton was a nationalist who emphasized strong central government and successfully argued that the implied powers of the Constitution could be used to fund the national debt, assume state debts, and create the government-owned Bank of the United States. These programs were funded primarily by a tariff on imports and a highly controversial excise tax on whiskey.

By 1792, the coalition led by Hamilton was opposed by a coalition led by Thomas Jefferson and James Madison. Hamilton's Federalist Party now had to compete with Jefferson's Republican Party. The parties fought over Hamilton's fiscal goals and national bank. Even more contentious was foreign policy - especially the Jay Treaty which Hamilton designed and which was ratified after a bitter fight. Embarrassed by a blackmail affair that became public, Hamilton resigned from office in 1795 and returned to the practice of law in New York. He kept his hand in politics and was a powerful influence on the cabinet of President Adams (1797-1801). In 1798, Hamilton called for mobilization against France after the XYZ Affair. The Quasi-War was never officially declared, but it was hard-fought at sea. To prepare for a war on land Hamilton secured control of a new army, which he trained, but no war took place when Adams found a peaceful solution.[5]

Hamilton's opposition to John Adams helped cause Adams' defeat in the 1800 elections. When Thomas Jefferson and Aaron Burr tied in the electoral college, Hamilton helped defeat his bitter personal enemy Burr and elect Jefferson as president. With his party's defeat, Hamilton's pleas for a strong central government, and more banks and industry, were discarded by the agrarianism of Jeffersonian Democracy.

Hamilton was always denounced by the Jeffersonians and later the Jacksonians, but his economic ideas, especially support for a flexible constitution, a powerful national government, a protective tariff and a national bank, were promoted in the 1830s and 1840s by the Whig Party and after 1854 by the newly created Republican Party, which hailed him as the nation's greatest Secretary of the Treasury.[
Henry Knox
a military officer of the Continental Army and later the United States Army, and also served as the first United States Secretary of War.

Born and raised in Boston, Massachusetts, he owned and operated a bookstore there, cultivating an interest in military history and joining a local artillery company. When the American Revolutionary War broke out in 1775, he befriended General George Washington, and quickly rose to become the chief artillery officer of the Continental Army. In this role he accompanied Washington on most of his campaigns, and had some involvement in many major actions of the war. He established training centers for artillerymen and manufacturing facilities for weaponry that were valuable assets to the fledgling nation.

Following the adoption of the United States Constitution, he became President Washington's Secretary of War. In this role he oversaw the development of coastal fortifications, worked to improve the preparedness of local militia, and oversaw the nation's military activity in the Northwest Indian War. He was formally responsible for the nation's relationship with the Indian population in the territories it claimed, at one point arguing that the country could take by force lands that Indian tribes were unwilling to sell.

He retired to what is now Thomaston, Maine in 1795, where he oversaw the rise of a business empire built on borrowed money. He died in 1806 from an infection received after swallowing a chicken bone, leaving an estate that was virtually bankrupt.
Edmund Randolph
an American attorney, the seventh Governor of Virginia, the second Secretary of State, and the first United States Attorney General.Randolph was selected as one of eleven delegates to represent Virginia at the Continental Congress in 1779, and served as a delegate through 1782. During this period he also remained in private law practice, handling numerous legal issues for George Washington among others.

Randolph was elected Governor of Virginia in 1786, that same year leading a delegation to the Annapolis Convention.
The following year, as a delegate from Virginia to the Constitutional Convention, Randolph introduced the Virginia Plan as an outline for a new national government. He argued against importation of slaves and in favor of a strong central government, advocating a plan for three chief executives from various parts of the country. The Virginia Plan also proposed two houses, where in both of them delegates were chosen based on state population. Randolph additionally proposed, and was supported by unanimous approval by the Convention's delegates, "that a Nationally Judiciary be established" (Article III of the constitution established the federal court system).[2] The Articles of Confederation lacked a national court system for the United States.

Randolph was also a member of the "Committee of Detail" which was tasked with converting the Virginia Plan's 15 resolutions into a first draft of the Constitution. Randolph refused to sign the final document, however, believing it had insufficient checks and balances, and published an account of his objections in October 1787. He nevertheless reversed his position at the Virginia Ratifying Convention in 1788 and voted for ratification of the Constitution because eight other states had already done so, and he did not want to see Virginia left out of the new national government.


Edmund Randolph[edit] Washington's CabinetRandolph was appointed as the first U.S. Attorney General in September 1789, maintaining precarious neutrality in the feud between Thomas Jefferson (of whom Randolph was a second cousin)[3] and Alexander Hamilton. When Jefferson resigned as Secretary of State in 1793, Randolph succeeded him to the position. The major diplomatic initiative of his term was the Jay Treaty with Britain in 1794, but it was Hamilton who devised the plan and wrote the instructions, leaving Randolph the nominal role of signing the papers. Randolph was hostile to the resulting treaty, and almost gained Washington's ear. Near the end of his term as Secretary of State, negotiations for Pinckney's Treaty were finalized.

[edit] ResignationA scandal involving an intercepted French message led to Randolph's resignation in August 1795. The British Navy had intercepted correspondence from the French minister, Joseph Fauchet, to the U.S. and turned it over to Washington. Washington was dismayed that the letters reflected contempt for the United States and that Randolph was primarily responsible. The letters implied that Randolph had exposed the inner debates in the cabinet to the French and told them that the Administration was hostile to France. At the very least, Elkins and McKitrick conclude, there "was something here profoundly disreputable to the government's good faith and character." Washington immediately overruled Randolph's negative advice regarding the Jay Treaty. A few days later Washington, in the presence of the entire cabinet, handed the minister's letter to Randolph and demanded he explain it. Randolph was speechless and immediately resigned. Elkins and McKitrick (pages 425-6) conclude that Randolph was not bribed by the French but "was rather a pitiable figure, possessed of some talents and surprisingly little malice, but subject to self-absorbed silliness and lapses of good sense."

After leaving the cabinet he returned to Virginia to practice law; his most famous case was that of defense counsel during Aaron Burr's trial for treason in 1807.
James Madison
an American politician and political philosopher who served as the fourth President of the United States (1809–1817) and is considered one of the Founding Fathers of the United States.

He was the principal author of the United States Constitution, and is often called the "Father of the Constitution". In 1788, he wrote over a third of the Federalist Papers, the most influential commentary on the Constitution. The first president to have served in the United States Congress, he was a leader in the 1st United States Congress, drafting many basic laws, and was responsible for the first ten amendments to the Constitution and thus is also known as the "Father of the Bill of Rights".[1] As a political theorist, Madison's most distinctive belief was that the new republic needed checks and balances to protect individual rights from the tyranny of the majority.[2][3][4][5]

As leader in the House of Representatives, Madison worked closely with President George Washington to organize the new federal government. Breaking with Treasury Secretary Alexander Hamilton in 1791, Madison and Thomas Jefferson organized what they called the Republican Party (later called the Democratic-Republican Party)[6] in opposition to key policies of the Federalists, especially the national bank and the Jay Treaty. He secretly co-authored, along with Thomas Jefferson, the Kentucky and Virginia Resolutions in 1798 to protest the Alien and Sedition Acts.

As Jefferson's Secretary of State (1801–1809), Madison supervised the Louisiana Purchase, doubling the nation's size, and sponsored the ill-fated Embargo Act of 1807. As president, he led the poorly prepared nation into the War of 1812 against Great Britain. A series of disasters at the beginning of the war damaged his reputation, but by 1814–15 American forces repulsed major British invasions, the Federalist opposition fell into disarray, and Americans felt triumphant at the end of the war despite its ending in stalemate for both sides. During and after the war, Madison reversed many of his positions. By 1815, he supported the creation of the second National Bank, a strong military, and a high tariff to protect the new factories opened during the war.
Charles Pinckney
an early American statesman of South Carolina, Revolutionary War veteran, and delegate to the Constitutional Convention. He was twice nominated by the Federalist Party as their presidential candidate, but he did not win either election.
General Anthony Wayne
a United States Army general and statesman. Wayne adopted a military career at the outset of the American Revolutionary War, where his military exploits and fiery personality quickly earned him a promotion to the rank of brigadier general and the sobriquet of Mad Anthony. Battled the indians in the northwest territory, helped to remove the indians and the British from American territory.
John Marshall
the Chief Justice of the United States (1801-1835) whose court opinions helped lay the basis for American constitutional law while promoting nationalism and making the Supreme Court of the United States a center of power with the capability of overruling Congress. Previously, Marshall had been a leader of the Federalist Party in Virginia and served in the United States House of Representatives from 1799 to 1800. He was Secretary of State under President John Adams from 1800 to 1801.

The longest-serving Chief Justice of the United States, Marshall dominated the Court for over three decades and played a significant role in the development of the American legal system. Most notably, he reinforced the principle that federal courts are obligated to exercise judicial review, by disregarding purported laws if they violate the Constitution. Thus, Marshall cemented the position of the American judiciary as an independent and influential branch of government. Furthermore, the Marshall Court made several important decisions relating to federalism, affecting the balance of power between the federal government and the states during the early years of the republic. In particular, he repeatedly confirmed the supremacy of federal law over state law, and supported an expansive reading of the enumerated powers.

Some of his decisions were unpopular. Nevertheless, Marshall built up the third branch of the federal government, and augmented federal power in the name of the Constitution, and the rule of law.[2] Marshall, along with Daniel Webster (who argued some of the cases), was the leading Federalist of the day, pursuing Federalist Party approaches to build a stronger federal government over the opposition of the Jeffersonian Republicans, who wanted stronger state governments.
Washington’s Farewell Address
Written by Washington near the end of his second term as President of the United States and before his retirement to his home at Mount Vernon. Originally published in David Claypoole's American Daily Advertiser on September 19, 1796 under the title "The Address of General Washington To The People of The United States on his declining of the Presidency of the United States," the letter was almost immediately reprinted in newspapers across the country and later in a pamphlet form.[1] The work was later named a "Farewell Address," as it was Washington's valedictory after 45 years of service to the new republic, first during the French and Indian War, through the American Revolution, and finally as the nation's first president.

The letter was originally prepared in 1792 with the help of James Madison,[2] as Washington prepared to retire following a single term in office. However, he set aside the letter and ran for a second term after the rancor between his Secretary of the Treasury, Alexander Hamilton, and his Secretary of State, Thomas Jefferson, convinced him that the growing divisions between the newly formed Federalist and Democratic-Republican parties, along with the current state of foreign affairs, would tear the country apart in the absence of his leadership.

Four years later, as his second term came to a close, Washington revisited the letter and with the help of Alexander Hamilton prepared a revision of the original draft to announce his intention to decline a third term in office. He also reflects on the emerging issues of the American political landscape in 1796, expresses his support for the government eight years after the adoption of the Constitution, defends his administration's record, and gives valedictory advice to the American people.[3]

The letter was written by Washington after years of exhaustion due to his advanced age, years of service to his country, the duties of the presidency, and increased attacks by his political opponents. It was published almost two months before the Electoral College cast their votes in the 1796 presidential election.
Thomas Jefferson
the third President of the United States (1801–1809) and the principal author of the Declaration of Independence (1776). An influential Founding Father, Jefferson envisioned America as a great "Empire of Liberty" that would promote republicanism.[2]

Jefferson served as the wartime Governor of Virginia (1779–1781), barely escaping capture by the British in 1781.[3] Many people disliked his tenure, and he did not win office again in Virginia.[4] From mid-1784 [5] through late 1789 [6] Jefferson lived outside the United States. He served in Paris initially as a commissioner to help negotiate commercial treaties. In May 1785 he succeeded Benjamin Franklin as the U.S. Minister to France.[7]

He was the first United States Secretary of State (1789–1793) under George Washington and advised him against a national bank and the Jay Treaty. He was the second Vice President (1797–1801) under John Adams. Winning on an anti-federalist platform, Jefferson took the oath of office and became President of the United States in 1801. As president he negotiated the Louisiana Purchase (1803), and sent the Lewis and Clark Expedition (1804–1806) to explore the vast new territory and lands further west.[8] Jefferson sponsored embargo laws that escalated tensions with Britain and France, leading to war with Britain in 1812 shortly after he left office.

He idealized the independent yeoman farmer as exemplar of republican virtues, distrusted cities and financiers, and favored states' rights and a limited federal government. Jefferson supported the separation of church and state[9] and was the author of the Virginia Statute for Religious Freedom (1779, 1786). Jefferson's revolutionary view on individual religious freedom and protection from government authority have generated much interest with modern scholars.[10] He was the eponym of Jeffersonian democracy and the co-founder and leader of the Democratic-Republican Party, which dominated American politics for 25 years.

Born into a prominent planter family, Jefferson owned hundreds of slaves throughout his life; he held views on the racial inferiority of Africans common for this period in time.[11] While historians long discounted accounts that Jefferson had an intimate relationship with his slave Sally Hemings, it is now widely held that he did and had six children by her.
XYZ Affair
a diplomatic event that strained relations between France and the United States, and led to an undeclared naval war called the Quasi-War. It took place from March of 1798 to 1800.[1]Three French agents, publicly referred to as X, Y, and Z, but later revealed as Jean Conrad Hottinguer, Pierre Bellamy and Lucien Hauteval, demanded major concessions from the United States as a condition for continuing bilateral peace negotiations. The concessions demanded by the French included 50,000 pounds sterling, a $12 million loan from the United States, a $250,000 personal bribe to French foreign minister Charles Maurice de Talleyrand, and a formal apology for comments made by President of the United States John Adams.[2]

The demand came during a meeting in Paris, France between the French agents and a three-member American commission consisting of Charles Cotesworth Pinckney, John Marshall, and Elbridge Gerry. Several weeks prior to the meeting with X, Y, and Z, the American commission had met with French foreign minister Talleyrand to discuss French retaliation to the Jay Treaty, which they perceived as evidence of an Anglo-American alliance. The French seized nearly 300 American ships bound for British ports in the Atlantic, Mediterranean, and Caribbean seas.[3] Adams decided on sending Pinckney as part of the commission as Franco-U.S. relations had recently worsened by Talleyrand's rejection of Pinckney as America's minister to France. The French continued to seize American ships, and the Federalist Party, incited by Alexander Hamilton, advocated going to war. Congress authorized the build-up of an army.[4]


A political cartoon depicting the incidentThe American delegates found these demands unacceptable, and answered, "Not a sixpence", but in the inflated rhetoric of the day, the response became the infinitely more memorable: "Millions for defense, sir, but not one cent for tribute!"[5]

The United States offered France many of the same provisions found in the Jay Treaty with Britain, but France reacted by deporting Marshall and Pinckney back to the United States, refusing any proposal that would involve these two delegates. Gerry remained in France, thinking he could prevent a declaration of war, but did not officially negotiate any further.[6]

Jeffersonian Republicans in Congress, thinking Adams might be hiding the truth, demanded he release the French proposals. Adams then released the report of the affair resulting in a wave of passionate anti-French sentiment across the U.S. that seriously damaged the Republicans and helped the Federalists win the 1798 elections.[7] A formal declaration of war was narrowly avoided by Adams' diplomacy, specifically by appointing new diplomats including William Vans Murray to handle the conflict.

The Quasi-War began in July, 1798. While there was no formal declaration of war, the conflict escalated with more French seizures of American merchant ships, American seizure of French merchant ships, and the abrogation of the Franco-American Alliance. Adams again sent negotiators on January 18, 1799, who eventually negotiated an end to hostilities through the Treaty of Mortefontaine. During negotiations with France, the U.S. began to build up its navy, a move long supported by Adams and Marshall, to defend against both the French and the British. In addition, in a speech delivered on July 16, 1797, Adams championed the formulation of a navy and army, while emphasizing the importance of renewing treaties with Prussia and Sweden.[8]
Naturalization Law
The third act of the Alien and Sedition Acts, it established a fourteen year probationary period before foreigners could apply for full us citizenship. The Federalists recognized that recent immigrants, especialy the Irish, tended to vote Republican. Teh Naturalization Law, therefore, was designed to keep "hordes of wild Irishmen: away form the polls for as long as possible.
Election of 1796
The United States presidential election of 1796 was the first contested American presidential election and the only one to elect a President and Vice President from opposing tickets.

With incumbent President George Washington having refused a third term in office, incumbent Vice President John Adams of Massachusetts was a candidate for the presidency on the Federalist Party ticket with former Governor Thomas Pinckney of South Carolina as the next most popular Federalist. Their opponents were former Secretary of State Thomas Jefferson of Virginia along with Senator Aaron Burr of New York on the Democratic-Republican ticket. At this point, each man from any party ran alone, as the formal position of "running mate" had not yet been established.

Unlike the previous election where the outcome had been a foregone conclusion, Democratic-Republicans campaigned heavily for Jefferson, and Federalists campaigned heavily for Adams. The debate was an acrimonious one, with Federalists tying the Democratic-Republicans to the violence of the French Revolution[1] and the Democratic-Republicans accusing the Federalists of favoring monarchism and aristocracy. In foreign policy, the Democratic-Republicans denounced the Federalists over Jay's Treaty, perceived as too favorable to Britain, while the French ambassador embarrassed the Democratic-Republicans by publicly backing them and attacking the Federalists right before the election.

Although Adams won, Thomas Jefferson received more electoral votes than Pinckney and was elected Vice-President.
Election of 1800
In the United States Presidential election of 1800, sometimes referred to as the "Revolution of 1800," Vice President Thomas Jefferson defeated incumbent president John Adams. The election was a realigning election that ushered in a generation of Democratic-Republican Party rule and the eventual demise of the Federalist Party in the First Party System. It was a lengthy, bitter rematch of the 1796 election between the pro-French and pro-decentralization Republicans under Jefferson and Aaron Burr, against incumbent Adams and Charles Pinckney's pro-British and pro-centralization Federalists. The central issues included opposition to the tax imposed by Congress to pay for the mobilization of the new army and the navy in the Quasi-War against France in 1798, and the Alien and Sedition Acts, by which Federalists were trying to stifle dissent, especially by Republican newspaper editors. While the Republicans were well organized at the state and local levels, the Federalists were disorganized, and suffered a bitter split between their two major leaders, President Adams and Alexander Hamilton. The jockeying for electoral votes, regional divisions, and the propaganda smear campaigns created by both parties made the election recognizably modern.[1]

The election exposed one of the flaws in the original Constitution. Members of the Electoral College could only vote for President; each elector could vote for two candidates, and the Vice President was the person who received the second largest number of votes during the election. The Republicans had planned for one of the electors to abstain from casting his second vote for Aaron Burr, which would have led to Jefferson receiving one electoral vote more than Burr. The plan, however, was bungled, resulting in a tied electoral vote between Jefferson and Burr. The election was then put into the hands of the outgoing House of Representatives controlled by the Federalist Party. Many Federalists voted for Burr, and the result was a week of deadlock. Federalist Alexander Hamilton, who detested both but preferred Jefferson to Burr, was one of those who vigorously lobbied against Burr. Burr remained in New York during the debates and votes, as his only daughter was married there on February 1, 1801. No evidence exists to prove that he did anything to sway the vote his way[2]. Hamilton's actions were one episode of the ill-fated relationship between Hamilton and Burr, which ended in Hamilton's fatal duel with Burr in 1804. In the absence of efforts on Burr's behalf, lobbying by Jefferson's supporters and Hamilton allowed Jefferson to ascend to the Presidency.

To rectify this flaw in the original presidential election mechanism, the Twelfth Amendment, ratified in 1804, was added to the United States Constitution, stipulating that electors make a discrete choice between their selections for President and Vice President.
Quasi-War
an undeclared war fought mostly at sea between the United States and French Republic from 1798 to 1800. In the United States, the conflict was sometimes also referred to as the Franco-American War, the Undeclared War with France, the Undeclared Naval War, the Pirate Wars, or the Half-War.
Convention of Mortefontaine
a treaty between the United States of America and France to settle the hostilities that had erupted during the Quasi-War. The Quasi-War, waged primarily in the Caribbean, had existed since the American delegation to France, arriving in 1797, had been told that America had to pay $250,000 to see—not negotiate with—the French ambassador. This incident, known as the XYZ Affair, was scandalous in America, infuriating both the Hamiltonians (Federalists) and the Jeffersonians. French warships seized American merchant ships in the Caribbean, and American privateers retaliated against French shipping.

By 1800, both sides wanted the incident buried, and so the end of hostilities in the Caribbean generally proceeded as smoothly as the end of the French-American alliance. The French, at the time, were at war with Britain and did not want the neutral United States drawn in on either side; a belligerent America allied with France would be quickly crushed by the British navy while a neutral America would be able to supply the French with desperately-needed grain. The United States, for the same reasons, wished to remain neutral. Since both parties had the same goal in mind, the Convention of 1800 resulted in a peaceful cessation of the alliance between the two countries (the alliance had no "expiration date" built in, so waiting until the alliance dissolved itself was impossible). U.S. President John Adams sent a commission composed of William Vans Murray, Oliver Ellsworth, and William Richardson Davie to negotiate the agreement.

The Convention of 1800 terminated the only formal treaty of alliance the United States had signed; it would be nearly a century and a half before the United States entered into another formal alliance.[1] This decision was strongly influenced by George Washington's 'farewell address' of four years earlier, together with new President John Adams' strongly independent foreign policy stance, particularly regarding European colonial powers.

Depredations against American shipping committed by the French during the Quasi-War led to claims against France that were relinquished by the terms of the Treaty. Since the claims against France were no longer valid, claimants continually petitioned Congress for the relief that had been waived. It was not until January 20, 1885 that a law was passed, 23 Stat. 283, that provided for consideration of the matter before the United States Court of Claims. The lead case, Gray v. United States, 21 Ct. Cl. 340, was decided May 17, 1886 in favor of the plaintiff, with the recommendation that Congress pay the claim. The cases continued in the court until 1915.
Treaty of Greenville
The Treaty of Greenville was signed at Fort Greenville (now Greenville, Ohio), on August 3, 1796, between a coalition of Native Americans & Frontiers men, known as the Western Confederacy, and the United States following the Native American loss at the Battle of Fallen Timbers. It put an end to the Northwest Indian War. The United States was represented by General "Mad Anthony" Wayne, who led the victory at Fallen Timbers. In exchange for goods to the value of $20,000 (such as blankets, utensils, and domestic animals), the Native Americans turned over to the United States large parts of modern-day Ohio, the future site of downtown Chicago,[nb 1][2] the Fort Detroit area, Maumee Ohio Area[3], and the Lower Sandusky Ohio Area[4].
Treaty of San Lorenzo
Pinckney's Treaty, also known as the Treaty of San Lorenzo or the Treaty of Madrid, was signed in San Lorenzo de El Escorial on October 27, 1795 and established intentions of friendship between the United States and Spain. It also defined the boundaries of the United States with the Spanish colonies and guaranteed the United States navigation rights on the Mississippi River. The treaty's full title is Treaty of Friendship, Limits, and Navigation Between Spain and the United States. Thomas Pinckney negotiated the treaty for the United States and Don Manuel de Godoy represented Spain. Among other things, it ended the first phase of the West Florida Controversy, a dispute between the two nations over the boundaries of the Spanish colony of West Florida.

The treaty was presented to the United States Senate on February 26, 1796 and after several weeks of debate was ratified on March 7, 1796. It was ratified by Spain on April 25, 1796 and ratifications were exchanged on that date. The treaty was proclaimed on August 3, 1796.

The Spanish, led by Manuel Godoy, were willing to negotiate with the United States, more from fear of a U.S.-British alliance which seemed imminent with the Jays Treaty of 1794. Less influential was the recently signed Treaty of Basilea which had ended the war between Spain and France.

By terms of the treaty, Spain and the United States agreed that the southern boundary of the United States with the Spanish Colonies of East Florida and West Florida was a line beginning on the Mississippi River at the 31st degree north latitude drawn due east to the middle of the Chattahoochee River and from there along the middle of the river to the junction with the Flint River and from there straight to the headwaters of the St. Marys River and from there along the middle of the channel to the Atlantic Ocean[1]. This describes the current boundary between the present states of Florida and Georgia and the line from the northern boundary of the Florida panhandle to the northern boundary of that portion of Louisiana east of the Mississippi. (The line ceases to be a border from the Pearl River to the Perdido River in order to provide the states of Mississippi and Alabama with seaports.)

This boundary had been in dispute since the British had expanded the territory of the Florida colonies while it was in their possession. They had moved the boundary from the 31st degree latitude northwards to a line drawn due east from the junction of the Yazoo River and the Mississippi, the present day location of Vicksburg, Mississippi. After the American Revolutionary War, Spain claimed the British border at the day of the Treaty of Paris while the United States insisted on the old boundary.

The treaty directed the United States and Spain to jointly survey the boundary line, and Andrew Ellicott served as the head of the U.S survey party. The treaty set the western boundary of the United States, separating it from the Spanish Colony of Louisiana as the middle of the Mississippi River from the northern boundary of the United States to the 31st degree north latitude. The agreement therefore put the lands of the Chickasaw and Choctaw Nations of American Indians within the new boundaries of the United States[2]. The United States and Spain agreed not to incite native tribes to warfare. Previously, Spain had been supplying weapons to local tribes for many years. Spain and the United States also agreed to protect the vessels of the other party anywhere within their jurisdictions and to not detain or embargo the other's citizens or vessels. The treaty also guaranteed navigation of the entire length of the river for both the United States and Spain. The territory ceded by Spain in this treaty was organized by the United States into the Mississippi Territory in 1798.
Alien and Sedition Acts
The Alien and Sedition Acts were four bills passed in 1798 by the Federalists in the 5th United States Congress during an undeclared naval war with France, later known as the Quasi-War. They were signed into law by President John Adams. Proponents claimed the acts were designed to protect the United States from enemy aliens, and to prevent seditious attacks from weakening the government. The Democratic-Republicans, like later historians, denounced them as being both unconstitutional and designed to stifle criticism of the administration, and as infringing on the right of the states to act in these areas. They became a major political issue in the elections of 1798 and 1800.
Virginia Resolution and Kentucky Resolution
The Kentucky and Virginia Resolutions (or Resolves) were political statements drafted in 1798 and 1799, in which the Kentucky and Virginia legislatures resolved not to abide by Alien and Sedition Acts. They argued that the Acts were unconstitutional and therefore void, and in doing so, they argued for states' rights and strict constructionism of the Constitution. They were written secretly by Vice President Thomas Jefferson and James Madison, respectively.

The principles behind the resolutions became known as the "Principles of '98". Adherents argue that the individual states can judge the constitutionality of central government laws and decrees, and can refuse to enforce laws deemed unconstitutional. Such refusal was called nullification in the Kentucky Resolutions of 1799, while the Virginia Resolutions of 1798 refer to "interposition" to express the idea of the states’ right to "interpose" between the federal government and the people of the state.

The Resolutions have been controversial since their passage, eliciting formal disapproval from seven state legislatures, with three others also expressing disagreement. In the years leading up to the Nullification Crisis, the resolutions divided Jeffersonian democrats, with states' rights proponents such as John C. Calhoun supporting the Principles of '98 and President Andrew Jackson opposing them. Years later, the passage of the Fugitive Slave Act of 1850 led anti-slavery activists to quote the Resolutions to support their calls on Northern states to nullify what they considered unconstitutional enforcement of the law.[1]
