Class A Felony

1) with intent to cause the death of another, he or she caused the death of another


2) under circumstances manifesting extreme indifference to human life, he or she recklessly engages in conduct which creates a grave risk of death, and then causes the death of another.


3) he or she commits or attempts to commit arson in the first degree, burglary in the first or second degree, escape in the first degree, rape in the first degree, robbery in any degree, sodomy in the first degree, aggravated child abuse, or any other felony clearly dangerous to human life and in the course of and in furtherance of the crime that they are committing or attempting to commit, or an immediate flight thereafter, they and any other participant causes the death of another.


4) he or she commits the crime of arson and a qualified governmental or volunteer fire fighter or other public safety officer dies while performing their duty as a result of the arson.

1) he or she recklessly causes the death of another.


2) he or she causes the death of another under circumstances that would be murder, except it was caused by sudden heat of passion caused by a provocation recognized by law, and before a reasonable time for the passion to call in for a reason to reassert itself.

Class B Felony

1) with intent to cause serious physical injury to another person, he or she causes serious physical injury to another person by means of a deadly weapon or dangerous instrument or,


2) with intent to disfigure another person seriously and permanently, or to destroy amputate or disable permanently a member or organ of the body of another


3) under circumstances manifesting extreme and difference to the value of human life he or she recklessly engages in conduct which creates a grave risk of death to another person, and thereby causes serious physical injury to another person.


4) in the course of and in furtherance of the commission or attempted commission of arson in the first degree, burglary in the first or second- degree, escaped in the first degree, kidnapping in the first degree, rape in the first degree, robbery in any degree, sodomy in the first degree or any other felony clearly dangerous to human life or in-flight immediately after he or she causes serious physical harm to another.


5) while driving under the influence of alcohol or a controlled substance or any combination thereof he or she causes serious physical injury to the person of another with a vehicle or vessel.

Class C Felony

1) with intent to cause serious physical injury to another person, here she causes serious physical injury to any person.


2) with intent to cause physical injury to another person, here she causes physical injury to any person by means of a deadly weapon or dangerous instrument.


3) he or she recklessly causes serious physical injury to another person by means of a deadly weapon or a dangerous instrument.


4) with intent to prevent a peace officer, emergency medical personnel, or a fire fighter from performing a lawful duty, he or she intends to cause physical injury and he or she causes physical injury to any person.


5) with intent to cause physical injury to a teacher or to an employee of a public educational institute during or as a result of the performance of his or her duty, he or she causes physical injury to any person.


6) for a purpose other than lawful medical or therapeutic treatment, he or she intentionally causes stupor, unconsciousness, or other physical or mental impairment or injury to another person by administering to him or her, without his or her consent, a drug, substance or preparation capable of producing the intended harm.

Class C misdemeanor

1) A person commits the crime of unlawful imprisonment in the second degree if he restrained another person.


B) A person does not commit a crime under the section if: the person restrained as a child less than 18 years old, and the actor is a relative of the child, and the actor sole purpose is to assume lawful control of the child.

1) A person commits a crime of kidnapping in the first degree if he or she abducts another person within intent to hold him for ransom or award, use him as a shield or hostage, accomplish the aid the commission of any felony or flight there from, inflict physical injury upon him, or to violate or abuse him sexually, to terrorize him or a third person, or interfere with the performance of any governmental or political function.
