How does the PT section ensure compliance within this chapter?
Investigates compiance on any rule or order issued
Investigates grounds for suspension, revocation, or refusal to issue or renew a license
Section may subpoena witnesses and documents in connection with its investigations
Why would the PT section use another court?
Does so through the attorney general or prosecuting attorney
Apply for an order enjoining the violation of the chapter
The court then can conduct a hearing, and may grant an injunction, restraining order, or other order as appropriate
This is in addition to all penalties provided by the PT chapter
When may another court take charge and conduct a prosecution?
Upon request from the prosecutuing attorney of a county, the village solicitor or the city director of law of a municipal corporation
What can investigators, hired by the section, do?
Have right to review, obtain copies, and audit the pt records and personnel files of licensees and limited permit holders
Can do this at place of business or any other place where documents may be
Investigators shall be given access during normal business hours
Are records public record that the board gathers for investigations?
They are confidential and NOT public records
Not subject to discovery in any civil or administartaive action
Can the board disclose info gathered in an investigation to federal, state, or local law enforcement?
Yes, but agency that receives this info shall comply with the same requirements regarding confidentitality as those with which the board must comply
Info may be admitted into evidence in a criminal trial in accoredance with the RUles of Evidence, but appropriate measures must be taken toe nsure confidentiality is maintained
Measures include sealing its records or redacting specific info from its records
Does the section conduct hearings?
Conducts hearings, keep records and minutes, and enforce the relevant section of this chapter
How much can the board charge for the licensure standards prescrbied by the relevant section of the chapter and the administrative code?
They shall publish and make it availaible
Fee no exceeding the actual cost of prinintg and mailing

A report for all of its official actions during teh year
Recommendations and findings with regard to the status of the professions

List of names of the section members
