Uniform Code of Military Justice (UCMJ)

Promotes good order and discipline, provides a bases for the administration of justice for the Armed Force


All members of the Armed Forces are responsible to uphold

Summary Court Martial

Composed of one AD officer captain or higher. Lowest level of authority to concern is a battalion commander.


May adjudge confinement up to one month with hard labor, hard labor without confinement up to 45 days, Restrictions up to 2 months, and forfeiture of up to one month’s pay.


Sergeants and above may not receive a reduction of more than one rank and labor without confinement

Special Court-Martial

May be composed of a military judge alone, or a military judge and not less that three active-duty armed service members. Enlisted may request that at least 1/3 of the members of the court be enlisted


Lowest level of authority to concern a special court martial is normally a squadron or battalion commander.


May award any punishment not forbidden by the UCMJ, including confinement for 6 months, hard labor without confinement for 3 months, or forfeiture or more than two-thirds pay for 6 months, bad conduct discharge, and reduction in rank

General Court Martial

Composed of a military judge alone, or a military judge and not less than five impartial active-duty armed service personnel


Lowest level of authority to convene a general court martial is usually the commanding general of a division, wing, base, or the equivalent


General Court Martial may adjudge any punishment not forbidden by the UCMJ

NJP

Gives the commander the ability to maintain good order and discipline


Administered for unit offenses of the UCMJ for which a maximum sentence, if tried would not result in a dishonorable discharge or confinement of greater than one year

NJR Accused Rights

Refuse NJP, demand trial by court-martial


Appeal the punishment if accused considers it unjust or disproportionate to the offense, submitted with a written statement explaining why accused believes punishment to be unjust through the chain of command within 5 days of imposition of the punishment

Sexual Harassment

Unacceptable and unprofessional behavior for military or civilian personnel that is dealt through the leadership and supervisory structire

Sexual assault

Criminal act and will not be tolerated. MC goals is to eliminate sexual assaults within the corps and assist those affected by sexual assault
