Bush officially declared that the detainees in Guantanamo Bay were ‘Unlawful Combatants’ and ineligible for the protection of the Geneva Convention on the Laws of War (cite). Here is the first problem. According to the Geneva Convention Relative to the Treatment of Prisoners of War, Article 5, a prisoner of war’s status must be determined by a tribunal in order to be declared an ‘Unlawful Combatant’ (Lucian E. Dervan 489). Two years later, in 2004, it was ruled in Supreme Court Case, Rasul v Bush, the US Court System had the authority to decide if a foreign national has been wrongfully imprisoned in Guantanamo Bay. The pressure from the International Human Rights activists and the Supreme Court Case ruling led to the establishment of Combatant Status Review Tribunals to determine the official status of these Guantanamo Bay detainees (Schumann 353). While this may seem to be a negligible act, the status of these detainees has a large impact on their treatment. A prisoner officially named ‘Unlawful Combatant’ is subject to the detaining state’s laws, and is not protected by the guidelines of the treatment of prisoners of war outlined in the Geneva Convention Relative to the Treatment of Prisoners of War.
