Contrary to pro-life hopes, the increasingly conservative judges that heard the original 1973 case, did not on its face overturn Roe v Wade. The effect, Planned Parenthood v Casey demanded that all patients that are undergoing the thought of an abortion have the information and the consent to make a well informed decision. The Supreme Court upheld all but the spousal notification requirement stating that that requirement placed the woman in undue harm and subjected them to physical and emotional distress. The holding in Casey reaffirmed the states duty to provide assistance but not to infringe on the privacy and reproductive rights of its female citizens. We have seen in Roe v Wade along with Planned Parenthood v Casey, the desire to protect…

STUDENT NOTES AND COMMENTS ON THE CASE: I stand by the Court’s decision to uphold Roe v. Wade because I believe that whether a woman chooses to abort her fetus or not should ultimately be left up to her. The State should not have the authority to forbid abortions up until the fetus is able to live outside of the womb, at which point I believe that it is not moral nor should it be legal to abort the fetus. I agree with the decision made in the case of Planned Parenthood v. Casey to uphold the…

Planned Parenthood V. Casey has pointed out “the ability of women to participate equally in the economic and social life of the Nation has been facilitated by their ability to control their reproductive lives”(Planned Parenthood,8).As human we always find a way to do things regardless if it is legal or not.” If abortion were illegal, women seeking to terminate their pregnancies would be forced to resort to unsafe and dangerous underground procedures.” (Abortion, paragraph 1). Many people believe…

There are a multitude of reasons, maybe better worded in this case as excuses, why abortion has remained such a polarizing issue in American society in the decades following the Supreme Court ruling, Roe v. Wade, in 1973. Roe v. Wade made abortions prior to the last three months of pregnancy legal and required “the state to justify any interference with the abortion decision by showing that it had a ‘compelling interest’ in doing so” (“Roe v. Wade - Then and Now”). In the case Casey v. Planned…

During this time Pennsylvania had placed requirements that needed to be meet before receiving an abortion. Physicians needed to make the women aware of the risks, there needed to be a mandatory 24hr waiting period, one parent consent requirement, clinics need to report the (age of women and the reason the abortion was being made). In this case courts used Roe v wade as a precedent and denied the spousal being notified; and it also created a less strict interpretation on “undue Burden”. This case…

Currently, women are being deprived of abortion services due to the restrictions implicated within the Hyde Amendment (McGee 89-90). Women often resort to raising money for the procedure, going so far as pursuing sex work in order to do so, or forgoing everyday necessities, such as rent, utilities, and groceries (McGee 102). As time goes on, the procedure is delayed, the cost of abortion increases, and the process becomes riskier (McGee 102-103). Planned Parenthood v. Casey even mandated that a…

Wade case in 1973 legalized a woman’s right to have an abortion, which has become one of the most significant Supreme Court decisions in American history. Prior to this decision, women often risked their lives and either tried do-it-yourself methods or sought back alley abortions; in the 1950s, approximately a million illegal abortions were performed in the U.S., and a thousand women died per year as a result (Boston Women’s Health Book Collective, 1998). Women who were victims of botched…

Is the notion of legal precedent molded by local interests? Barbara Yngvesson, in her essay entitled Inventing Law in Local Settings: Rethinking Popular Legal Culture, asserts that the foundation of justice and communal identity rests with the American court system. Though all members of the judiciary body remain “unbiased,” this idea suggests an overpowering force behind local petitions which are, thus, used as vehicles to deliver justice and identity. Linda Greenhouse, author of Becoming…
